SHAH\n\t\t\n\t\n\n \n\nDate\n: 03\/09\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\npetitioner has prayed for an appropriate writ, direction or order<br \/>\nquashing and setting aside the impugned<br \/>\njudgment and award dated 02.01.2009 passed by the learned Presiding<br \/>\nOfficer, Labuor Court, Amreli in Reference (L.C.A.) No.153\/2001, by<br \/>\nwhich the Labour Court has dismissed the said reference.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner was serving as daily wager Chokidar and even according to<br \/>\nhim he worked for only 13 months and was paid the wages at the rate<br \/>\nof Rs.40 per month.  Even according to the petitioner, his services<br \/>\ncame to be terminated orally on and from 01.06.1986.  That after a<br \/>\nperiod of 15 years, the petitioner raised industrial dispute<br \/>\nchallenging his alleged termination with effect from 01.06.1986,<br \/>\nwhich was referred to Labour Court, Amreli which was numbered as<br \/>\nReference (L.C.A.) No.153\/2001.  On appreciation of evidence and<br \/>\nconsidering the fact that industrial dispute was raised after a<br \/>\nperiod of 15 years, the Labour Court held that there was no<br \/>\nretrenchment and\/or termination at all but the petitioner voluntarily<br \/>\nabandoned the services and consequently the Labour Court dismissed<br \/>\nthe said reference.  Being aggrieved and dissatisfied with the<br \/>\naforesaid judgment and award passed by the Labour Court, Amreli dated<br \/>\n02.01.2009 passed in Reference (L.C.A.) No.153\/2001, petitioner has<br \/>\npreferred the present Special Civil Application under Article 227 of<br \/>\nthe Constitution of India.\n<\/p>\n<p>3.\tShri<br \/>\nJadeja, learned advocate appearing on behalf of the petitioner<br \/>\nvehemently submitted that even in the cross-examination, the witness<br \/>\nwho came to be examined on behalf of the respondent has admitted that<br \/>\nat the time of termination, no seniority list was maintained.<br \/>\nTherefore, it is to be presumed that the petitioner was terminated.<br \/>\nTherefore, it is submitted that finding given by the Labour Court<br \/>\nthat the petitioner had voluntarily abandoned the service is contrary<br \/>\nto the evidence on record.  It is submitted that at the relevant time<br \/>\nwhen the services of the petitioner was terminated, no retrenchment<br \/>\ncompensation was paid though he completed 240 days of service and<br \/>\nthus, there was committed breach of Section 25(F) of the Industrial<br \/>\nDisputes Act and therefore, the Labour Court ought to have allowed<br \/>\nthe reference by directing the respondent to reinstate the<br \/>\npetitioner.\n<\/p>\n<p>4.\tHaving<br \/>\nheard Shri Jadeja, learned advocate appearing on behalf of the<br \/>\npetitioner and considering the impugned judgment and award, it<br \/>\nappears that the learned Labour Court has, on appreciation of<br \/>\nevidence and considering the fact that industrial dispute was raised<br \/>\nafter a period of more than approximately 15 years, held that the<br \/>\npetitioner had voluntarily abandoned the work and therefore, he did<br \/>\nnot approach the Industrial Tribunal at the relevant time.  Even the<br \/>\naforesaid finding is on appreciation of evidence which is not<br \/>\nrequired to be interfered with by this Court in exercise of powers<br \/>\nunder Article 227 of the Constitution of India.  It is an admitted<br \/>\nposition even according to the petitioner himself that in the year<br \/>\n1986, he worked only for 13 months and that too as daily wager peon<br \/>\nand nothing is on record that for how many days, he has worked in the<br \/>\nyear 1986.
