The appellant has preferred this criminal appeal<br \/>\n  against  the  judgment of conviction  and  order  of<br \/>\n  sentence dated              07-06-1999, passed by the<br \/>\n  2nd Additional Sessions Judge, Baloda Bazar, District<br \/>\n  Raipur  in S.T.No.451\/1996, whereby the learned  2nd<br \/>\n  Additional  Sessions  Judge  while  acquitting   the<br \/>\n  appellant of the charge under Section 376 of the IPC,<br \/>\n  convicted  him  for  commission  of  minor   offence<br \/>\n  punishable under Section 509 of the IPC and sentenced<br \/>\n  him to undergo simple imprisonment for 6 months and to<br \/>\n  pay a fine of Rs.500\/-, in default of payment of fine<br \/>\n  to further undergo simple imprisonment for 3 months.\n<\/p>\n<p>2.    The  prosecution story in short is that on  7-8-<br \/>\n  1996  at  8.00 am.  Man Bai (P.W.-4) along with  her<br \/>\n  brother-in-law Doctor Sahu (P.W.1) had gone to plough<br \/>\n  their field. After 1:30 to 2:00 hrs., leaving Man Bai<br \/>\n  in the field, Doctor Sahu went adjacent field to pluck<br \/>\n  datoon. Man Bai was alone in the field. The appellant<br \/>\n  came there and caught hold her from her back side and<br \/>\n  attempted to open her saree. She raised hue  &amp;  cry,<br \/>\n  thereupon;  the accused slapped her and covered  her<br \/>\n  mouth with his hands. Doctor Sahu, on hearing the hue<br \/>\n  &amp;  cry  came  there and on seeing Doctor  Sahu,  the<br \/>\n  appellant fled from the scene of occurrence. Man Bai &amp;<br \/>\n  Doctor Sahu thereafter came back to their home. After<br \/>\n  few hours Doctor Sahu came from outside and told Man<br \/>\n  Bai  that  some persons have caught a  boy,  go  and<br \/>\n  identify him. Both of them went there and identified<br \/>\n  the appellant as accused. The matter was reported by<br \/>\n  Man  Bai.   First  Information Report  (Ex.P\/1)  was<br \/>\n  registered   in  the  Police  Station   at   Palari.<br \/>\n  Investigation took place and after completion of the<br \/>\n  investigation, charge sheet under Section  376  read<br \/>\n  with  Section 511 was filed in the Court of Judicial<br \/>\n  Magistrate First Class, Baloda Bazar, who, in  turn,<br \/>\n  committed the case to the Sessions Judge, Raipur. The<br \/>\n  learned Sessions Judge made over the case to the 2nd<br \/>\n  Additional  Sessions Judge, Baloda Bazar for  trial.<br \/>\n  The learned 2nd Additional Sessions Judge has framed<br \/>\n  charge  under  Section 376 of the  IPC  against  the<br \/>\n  appellant. Charge was read over and was explained to<br \/>\n  the appellant. The appellant pleaded innocence and his<br \/>\n  defence was that he has been falsely implicated in the<br \/>\n  offence.\n<\/p>\n<p>3.    The learned 2nd Additional Sessions Judge, after<br \/>\n  evaluating  the  evidence available  on  record  and<br \/>\n  hearing the counsel for respective parties, acquitted<br \/>\n  the appellant- Lakhanlal Verma under Section 376  of<br \/>\n  the IPC, however, convicted him under Section 509 of<br \/>\n  I.P.C., as mentioned above.\n<\/p>\n<p>4.    I  have heard learned counsel appearing for both<br \/>\n  the  parties at length and also perused the material<br \/>\n  available on record.\n<\/p>\n<p>5.    Relying  upon the statement of Man Bai  (P.W.4),<br \/>\n  the  learned Court below has held that the appellant<br \/>\n  did not commit offence punishable under Section 376 of<br \/>\n  the  IPC or Section 376 read with Section 511 of the<br \/>\n  IPC  or  Section 354 of the IPC and  held  that  the<br \/>\n  offence committed by the appellant falls under Section<br \/>\n  509  of the IPC. Therefore, the learned Court  below<br \/>\n  convicted and sentenced the appellant under  Section<br \/>\n  509 of the IPC and acquitted him of the charges under<br \/>\n  Section 376 of the IPC.\n<\/p>\n<p>6.   Sections 375 reads as under:-\n<\/p>\n<p>  375  .Rape-  A  man  is said to commit  &#8220;rape&#8221;  who,<br \/>\n  except  in the case hereinafter excepted, has sexual<br \/>\n  intercourse   with   a  woman  under   circumstances<br \/>\n  falling    under   any   of   the   six    following<br \/>\n  descriptions:-\n<\/p>\n<p>  First.-   Against her will<\/p>\n<p>  Secondly.- Without her consent.\n<\/p>\n<p>  Thirdly.-  With  her consent, when her  consent  has<br \/>\n  been  obtained by putting her or any person in  whom<br \/>\n  she is interested in fear of death or of hurt.\n<\/p>\n<p>  Fourthly.-  With  her consent, when  the  man  knows<br \/>\n  that he is not her husband, and that her consent  is<br \/>\n  given  because she believes that he is  another  man<br \/>\n  to  whom  she is or believes herself to be  lawfully<br \/>\n  married.\n<\/p>\n<p>  Fifthly.-  With  her consent, when at  the  time  of<br \/>\n  giving  such  consent, by reason of  unsoundness  of<br \/>\n  mind  or intoxication or the administration  by  him<br \/>\n  personally  or through another of any stupefying  or<br \/>\n  unwholesome  substance, she is unable to  understand<br \/>\n  the  nature  and consequences of that to  which  she<br \/>\n  gives consent.\n<\/p>\n<p>  Sixthly.- with or without her consent, when  she  is<br \/>\n  under sixteen years of age.\n<\/p>\n<p>7.   Section 354 of the IPC reads as under:-\n<\/p>\n<blockquote><p>     354.  Assault  or criminal force  to  woman  with<br \/>\n     intent  to outrage her modesty. -Whoever assaults<br \/>\n     or uses criminal force to any woman, intending to<br \/>\n     outrage  or knowing it to be likely that he  will<br \/>\n     thereby  outrage her modesty, shall  be  punished<br \/>\n     with  imprisonment  of either description  for  a<br \/>\n     term which may extend to two years, or with fine,<br \/>\n     or with both.\n<\/p><\/blockquote>\n<p>8.   Section 509 of the IPC reads as under:-\n<\/p>\n<blockquote><p>     509. Word, gesture or act intended to insult  the<br \/>\n     modesty  of  a woman.-     Whoever, intending  to<br \/>\n     insult the modesty of any woman, utters any word,<br \/>\n     makes  any  sound  or gesture,  or  exhibits  any<br \/>\n     object,  intending that such word or sound  shall<br \/>\n     be heard, or that such gesture or object shall be<br \/>\n     seen, by such woman, or intrudes upon the privacy<br \/>\n     of  such  woman,  shall be punished  with  simple<br \/>\n     imprisonment for a term which may extend  to  one<br \/>\n     year, or with fine, or with both.\n<\/p><\/blockquote>\n<p>9.   Section 222 of the Cr.P.C. reads as under:-\n<\/p>\n<blockquote><p>     222.  When  offence  proved included  in  offence<br \/>\n     charged.-  (1) When a person is charged  with  an<br \/>\n     offence  consisting  of  several  particulars,  a<br \/>\n     combination  of some only of which constitutes  a<br \/>\n     complete  minor offence, and such combination  is<br \/>\n     proved,  but  the remaining particulars  are  not<br \/>\n     proved, he may be convicted of the minor offence,<br \/>\n     though he was not charged with it.\n<\/p><\/blockquote>\n<blockquote><p>     2.   When a person is charged with an offence and<br \/>\n     facts  are  proved which reduce  it  to  a  minor<br \/>\n     offence,  he  may  be  convicted  of  the   minor<br \/>\n     offence, although he is not charged with it.\n<\/p><\/blockquote>\n<blockquote><p>     3.   When a person is charged with an offence, he<br \/>\n     may  be  convicted of an attempt to  commit  such<br \/>\n     offence  although the attempt is  not  separately<br \/>\n     charged.\n<\/p><\/blockquote>\n<blockquote><p>     4.    Nothing in this section shall be deemed  to<br \/>\n     authorize a conviction of any minor offence where<br \/>\n     the  conditions requisite for the  initiation  of<br \/>\n     proceedings in respect of that minor offence have<br \/>\n     not been satisfied.\n<\/p><\/blockquote>\n<p>10.  From reading all the above sub-Sections together,<br \/>\n  it is clear that the Court may convict and sentence a<br \/>\n  person for an offence which is minor in comparison to<br \/>\n  the  one  for which he is tried. The above provision<br \/>\n  does not authorize the Court to convict and sentence<br \/>\n  to  an offender for an offence which is not minor in<br \/>\n  comparison to the offence for which offender is charge<br \/>\n  sheeted and tried. From reading Section 376, 354 &amp; 509<br \/>\n  of  the  IPC  it  is manifest that no ingredient  of<br \/>\n  offence punishable under Section 509 of the IPC falls<br \/>\n  within  any  of the ingredient of offence punishable<br \/>\n  under Section 376 or 354 of the IPC. Therefore, if an<br \/>\n  offender has been charged and tried for commission of<br \/>\n  offence punishable under Section 376 of the IPC  and<br \/>\n  after  trial it comes to the conclusion that offence<br \/>\n  under Sections 376 of the IPC has not been proved, the<br \/>\n  Court below has no authority to convict and sentence<br \/>\n  to  the  offender  for an independent  offence  i.e.<br \/>\n  offence under Section 509 of the IPC, which  is  not<br \/>\n  minor  in nature of offence punishable under Section<br \/>\n  376  of the IPC. Therefore, the learned trial  Court<br \/>\n  erred in convicting and sentencing the appellant under<br \/>\n  Section 509 of the IPC in the instant trial which was<br \/>\n  conducted  by  the  trial  Court  for  the   offence<br \/>\n  punishable under Section 376 of the IPC.\n<\/p>\n<p>11.  So far as evidence is concerned, Man Bai (P.W.4),<br \/>\n  in  her cross-examination of para-5 has stated  that<br \/>\n  vfHk;qDr  us eq&gt;s uaxk ugha fd;k Fkk A vfHk;qDr  Hkh<br \/>\n  uaxk  ugha gqvk Fkk A ;g dguk lgh gS fd eSa  &gt;qd  dj<br \/>\n  fuankbZ dk dke dj jgh Fkh rks ihNs ls vfHk;qDr  vk;k<br \/>\n  vkSj esjs dNksjk dks [khapk rks eSa vfHk;qDr dks xkyh<br \/>\n  nh ftl ij vfHk;qDr us ,d &gt;kiM+ ekjk vkSj Hkkx x;k  A<br \/>\n  She also stated in para-8 that vfHk;qDr dks Hkkxrs le;<br \/>\n  ihNs ls ns[kh Fkh mldk psgjk ugha ns[k ik;h Fkh A esjs<br \/>\n  nsoj MkWDVj lkgw Hkh vfHk;qDr dks Hkkxrs gq, ns[kk gS<br \/>\n  mlus  Hkh vkeus&amp;lkeus ugha ns[kk gS A In para-9  she<br \/>\n  further stated that esjs nsoj MkWDVj us vfHk;qDr dks<br \/>\n  &#8216;kd ds vk\/kkj ij idM+ok fn;k A Another witness P.W.1-<br \/>\n  Doctor  Sahu  stated that &#8220;esjh HkkHkh ekuckbZ  [ksr<br \/>\n  fuankbZ dj jgh Fkh A esjh HkkHkh ekuckbZ MkWDVj&amp;MkWDVj<br \/>\n  dh  vkokt nh ftl ij eSa vkokt lqudj nkSM+rs gq, vk;k<br \/>\n  rks ns[kk fd esjh HkkHkh lksbZ gq, Fkh vkSj vfHk;qDr<br \/>\n  mlds mij p&lt;+k gqvk Fkk vkSj mldk eqag nck;k gqvk Fkk A<br \/>\n  But  he did not state the above statement before the<br \/>\n  police under Section 161 of Cr.P.C. (Ex.D-1).  There<br \/>\n  are  only  two  witnesses  of  the  incident.  There<br \/>\n  statements are contradictory to each other. Man  Bai<br \/>\n  (P.W.4)  even did not see the face of the appellant.<br \/>\n  His   brother-in-law  Doctor  Sahu  exaggerated  his<br \/>\n  statement but his evidence is contradictory with his<br \/>\n  previous  statement  recorded by  the  police  under<br \/>\n  Section 161 of the Cr.P.C, on material point. In these<br \/>\n  circumstances,  their evidence is contradictory  and<br \/>\n  unreliable. Therefore, no conviction is possible only<br \/>\n  on the basis of these two witnesses.\n<\/p>\n<p>12.   So  far as legal part is concerned, the  learned<br \/>\n  trial  Court  eared in recording the conviction  and<br \/>\n  sentencing the appellant under Section 509 of the IPC<br \/>\n  for which appellant neither has been charged nor the<br \/>\n  offence is minor offence of Section 376 of the IPC. So<br \/>\n  far  as  evidence is concerned there is no  reliable<br \/>\n  evidence  available against the appellant which  may<br \/>\n  lead conviction for commission of any of the offence.\n<\/p>\n<p>13.   In  the  result, the appeal succeeds. Conviction<br \/>\n  for offence under Section 509 of the IPC recorded by<br \/>\n  the  trial  Court and sentenced passed by the  trial<br \/>\n  Court  for committing the said offence is set aside.<br \/>\n  The  appellant  is  acquitted of the  offence  under<br \/>\n  Section  509  of  the IPC.
