Petitioner.\n                                      Versus\n                               STATE OF BIHAR\n                                     -----------\n<\/pre>\n<p>3.       30.03.2011                 Heard learned counsel for the petitioner<\/p>\n<p>                       and learned counsel for the State.\n<\/p>\n<p>                                    The prayer for bail of the petitioner was<\/p>\n<p>                       earlier rejected by order dated 5.10.2009 in Cr. Misc.<\/p>\n<p>                       No. 32893 of 2009 with an observation that the<\/p>\n<p>                       petitioner could renew his prayer for bail after<\/p>\n<p>                       completing one and a half year of his judicial custody.<\/p>\n<p>                                    Learned counsel appearing on behalf of the<\/p>\n<p>                       petitioner would submit that the petitioner is in custody<\/p>\n<p>                       since 10th April 2009 and he has already remained in<\/p>\n<p>                       jail for nearly two years.\n<\/p>\n<p>                                  That being so, this Court, in keeping with the<\/p>\n<p>                       earlier observation made in the order dated 5.10.2009,<\/p>\n<p>                       would direct the petitioner, namely, Md. Samad to be<\/p>\n<p>                       released    on bail on furnishing bail bond of Rs.<\/p>\n<p>                       10,000\/- (ten thousand) with two sureties of the like<\/p>\n<p>                       amount each to the satisfaction of Additional District<\/p>\n<p>                       &amp; Sessions Judge, Fast Track Court No.3rd, Munger in<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>            connection with Sessions Trial No. 688 of 2009, arising<\/p>\n<p>            out of Munger Mufassil P.S. Case No. 88 of 2009,<\/p>\n<p>            subject to the following conditions:-<\/p>\n<p>                      (i) The two bail bonds will be furnished, one<\/p>\n<p>            by the Government servant and the other by a close<\/p>\n<p>            family relative.\n<\/p>\n<p>                       (ii) The petitioner will remain present in<\/p>\n<p>            course of trial on each and every day and his absence<\/p>\n<p>            even for a single day would automatically entail the<\/p>\n<p>            consequences of cancellation of his bail.<\/p>\n<p>                      (iii) The petitioner in case is now made<\/p>\n<p>            accused in any other criminal case, that would itself<\/p>\n<p>            lead to cancellation of his bail.\n<\/p>\n<p>                        Subject to the aforementioned conditions,<\/p>\n<p>            the prayer for bail of the petitioner is allowed.<\/p>\n<pre>kanchan\/-                          ( Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.Samad vs State Of Bihar on 30 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
