     The petitioner had filed Bail Application No.6007 of 2009<\/p>\n
under Section 438 of the Code of Criminal Procedure for<\/p>\n
anticipatory bail. That application was dismissed by the order<\/p>\n
dated 27th October, 2009. The present Bail Application, namely,<\/p>\n
Bail Application No.7257 of 2009 is filed by the petitioner for the<\/p>\n
same relief.\n<\/p>\n
     2.   For the sake of convenience, the order dated 27th<\/p>\n
October, 2009 in Bail Application No.6007 of 2009 is extracted<\/p>\n
below:\n<\/p>\n
                 “This is an application for anticipatory bail<\/p>\n
           under Section 438 of the Code of Criminal<\/p>\n
           Procedure. The petitioner is accused No.1 in<\/p>\n
           Crime No.172 of 2009 of Melukavu Police<\/p>\n
           Station, Kottayam District.\n<\/p><\/blockquote>\n
                 2.    The offences alleged against the<\/p>\n
           petitioner are under Sections 353 and 341 read<\/p>\n
           with Section 34 of the Indian Penal Code.<\/p>\n<\/blockquote>\n
                 3.    On 4.7.2009 at 4.30 A.M., the<\/p>\n
           Intelligence Officer (IB), Intelligence Squad of<\/p>\n

            the Commercial Taxes Department, Thodupuzha<\/p>\n
            and the inspectors were conducting vehicle<\/p>\n
            checking at Muttom. A Tata mini lorry bearing<\/p>\n
            registration No.KL9Q 8040 was directed to be<\/p>\n
            stopped. It is stated that the lorry was having<\/p>\n
            full load of live chicken.   The driver of the<\/p>\n
            vehicle did not stop. He drove the vehicle in<\/p>\n
            high speed towards Melukavu direction. The<\/p>\n
            officers of the Commercial Taxes informed the<\/p>\n
            Melukavu Police Station over phone.       Some<\/p>\n
            police men tried to intercept the mini lorry.<\/p>\n
            But, the mini lorry was not stopped. The road<\/p>\n
            was a Ghat road and one side of the road, it was<\/p>\n
            deep    valley. Another   vehicle,  namely,    a<\/p>\n
            Mahindra Scorpio jeep bearing registration<\/p>\n
            No.KL07AX      837 overtook the department<\/p>\n
            vehicle. Thereafter, the Scorpio jeep was driven<\/p>\n
            in a zigzag manner so as to prevent the<\/p>\n
            department jeep from overtaking the mini lorry.<\/p>\n
            The mini lorry could thus escape from the<\/p>\n
            inspection by the officers of the Commercial<\/p>\n
            Taxes Department.\n<\/p><\/blockquote>\n
                  4.   The allegation is that the petitioner<\/p>\n
            was driving the mini lorry. On 7.7.2009, the<\/p>\n
            Intelligence Officer (IB), Commercial Taxes,<\/p>\n
            Idukki at Thodupuzha submitted a detailed<\/p>\n
            petition to the Station House Officer, Melukavu<\/p>\n

            Police Station. The F.I.R. Was registered only<\/p>\n
            on 13.9.2009.\n<\/p><\/blockquote>\n
                  When a serious allegation is raised<\/p>\n
            involving offence under Section 353 by the<\/p>\n
            Commercial Taxes Officer and the grievance is<\/p>\n
            put in writing, normally there should not be any<\/p>\n
            delay to register the F.I.R. In the present case,<\/p>\n
            even before filing the petition, when driver of<\/p>\n
            the mini lorry was trying to escape, information<\/p>\n
            was given to the police. The police personnel of<\/p>\n
            Melukavu Police Station tried to intercept the<\/p>\n
            vehicle. That means, the police officers were<\/p>\n
            also aware of the incident.      Even without a<\/p>\n
            petition from the officers of the Commercial<\/p>\n
            Taxes Department, the police could register a<\/p>\n
            crime.   Why such delay was occasioned is a<\/p>\n
            matter to be explained by the Sub Inspector of<\/p>\n
            Police, Melukavu. A report shall be filed by the<\/p>\n
            Sub Inspector of Police, Melukavu Police<\/p>\n
            Station within a period of two weeks.<\/p>\n<\/blockquote>\n
                  From the facts narrated above, it is clear<\/p>\n
            that the petitioner is not entitled to the<\/p>\n
            discretionary remedy under Section 438 of the<\/p>\n
            Code of Criminal Procedure. The prosecution<\/p>\n
            case is that the petitioner was driving the lorry.<\/p>\n
            The discretionary relief under Section 438 of<\/p>\n
            Crl.P.C., if granted in favour of the petitioner, it<\/p>\n

            would adversely affect the proper investigation<\/p>\n
            of the case.\n<\/p><\/blockquote>\n
                 For the aforesaid reasons, the Bail<\/p>\n
            Application is dismissed.    However, the Bail<\/p>\n
            Application shall be posted after two weeks for<\/p>\n
            getting the report from the Sub Inspector of<\/p>\n
            Police, Melukavu Police Station.”<\/p><\/blockquote>\n
      There are no compelling circumstances or change of<\/p>\n
circumstances warranting the consideration of the matter afresh.<\/p>\n
It is not proper to entertain a second application for bail in the<\/p>\n
facts and circumstances of the case.<\/p>\n
      The Bail Application is accordingly dismissed.<\/p>\n
