KRISHNAN, J.\n                  ...........................................\n                  M.A.C.A.No.2360 OF 2009\n                 .............................................\n           Dated this the 3rd day of February, 2010.\n\n                        J U D G M E N T\n<\/pre>\n<p>     This is an appeal preferred against the award of the<\/p>\n<p>Claims Tribunal, Kozhikode in              OP(MV)No.592\/2004.         The<\/p>\n<p>claimant was a pillion rider of a motor cycle and he was<\/p>\n<p>hit by a jeep KLL 6616. The Tribunal had dismissed the<\/p>\n<p>application on the ground that              the accident is not properly<\/p>\n<p>proved.\n<\/p>\n<p>      2. I had carefully gone through the documents given<\/p>\n<p>to  me     by the  counsel for the appellant as well as the<\/p>\n<p>insurance company.        It is true that in the first Information<\/p>\n<p>Statement there is a mistake which shows that the number<\/p>\n<p>of the vehicle is shown as KLZ 6616. The document which<\/p>\n<p>was made available before me by the insurance company<\/p>\n<p>would reveal that the Additional Motor Vehicle Inspector<\/p>\n<p>has inspected    the    vehicle KLL6616                  and not KLZ 6616.<\/p>\n<p>Similarly there is another mistake in the wound certificate<\/p>\n<p>which would indicate as if that the bike had been hit by a<\/p>\n<p>bus and not by a jeep.\n<\/p>\n<p><span class=\"hidden_text\">                               : 2 :<\/span><br \/>\nM.A.C.A.No.2360 OF 2009<\/p>\n<p>      3. The learned counsel for the appellant would submit<\/p>\n<p>that if an opportunity is given to produce    AMVI&#8217;s  report<\/p>\n<p>as well as the charge sheet,     the conscience of the court<\/p>\n<p>can be satisfied regarding the accident.<\/p>\n<p>      4. I am inclined to grant an opportunity in this case<\/p>\n<p>especially for the reason that there has been amputation of<\/p>\n<p>the   left  index    finger      which  requires sympathetic<\/p>\n<p>consideration as well and technicality shall not be used to<\/p>\n<p>defeat the ends of justice .\n<\/p>\n<p>      5. Therefore    I set aside   the award passed by the<\/p>\n<p>Tribunal and remit the case back to the Tribunal with a<\/p>\n<p>direction to the claimant to produce necessary documents,<\/p>\n<p>enter the box and tender evidence in support of the accident.<\/p>\n<p>Equal opportunity      be given to the insurance company as<\/p>\n<p>well and the matter be disposed of in accordance with law.<\/p>\n<p>The parties are directed to appear before the Tribunal on<\/p>\n<p>3.3.2010.    If the insurance company is made liable, need<\/p>\n<p>less to say that interim award amount has to be given credit<\/p>\n<p>in the final compensation.\n<\/p>\n<p>      Disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                    M.N.
