Respondent No.1 was paid salary during the pendency of the<br \/>\npetition under the order of the Court and on dismissal of the<br \/>\npetition, the Court ought to have ordered him either to repay the<br \/>\nsalary that he has received or at least, the Government should<br \/>\nrecover the same.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Mr.Soni has reiterated the grounds and stated that the<br \/>\nGovernment may be asked either to release more grant or to recover<br \/>\nthe same as per the direction of the learned Single Judge in the<br \/>\nimpugned order passed in the Civil Application.\n<\/p>\n<p>5.\tWe<br \/>\ndo not find any reason nor the learned advocate for the appellant is<br \/>\nable to show a justifiable reason for interfering with the order of<br \/>\nthe learned Single Judge. The learned Single Judge has, while<br \/>\ndismissing the petition, observed that respondent No.1, Government<br \/>\nshall be at liberty to effect necessary recovery from the petitioner<br \/>\nin accordance with law. We are of the view that no Letters Patent<br \/>\nAppeal can be entertained in such a eventuality, where prayers made<br \/>\nare as under:-\n<\/p>\n<p>\t (A)\t\t&#8212;&#8211;\t\t&#8212;-\n<\/p>\n<p> (B)\tBe<br \/>\npleased to quash and set aside and reverse the judgment and order<br \/>\ndated 2.3.2010 passed in Civil Application No.3628 of 2009 in Special<br \/>\nCivil Application No. 3027 of 1992 and further be pleased to allow<br \/>\nthe said Civil Application and grant the prayers made therein + the<br \/>\namount paid thereafter to respondent No.1 under the interim order<br \/>\npassed in Special Civil Application No.3027 of 1992, as salary grant,<br \/>\nspecial grant or on any other head, by exercising the powers under<br \/>\nClause 15 of the Letters Patent.\n<\/p>\n<p>(C)\t&#8230;.\t\t&#8230;.\t\t&#8230;.\n<\/p>\n<p>6.\tThe<br \/>\nissue under consideration is likely to raise a number of disputed<br \/>\nquestions of fact. We are, therefore, not inclined to entertain this<br \/>\nLetters Patent Appeal. The appeal fails and stands dismissed.\n<\/p>\n<p> Order<br \/>\non C.A.
