Justice K.SURENDRA MOHAN\n\n Dated :08\/02\/2010\n\n O R D E R\n                K.SURENDRA MOHAN, J.\n             -------------------------------------------\n                W.P.(C) No.37520 of 2009\n             -------------------------------------------\n        Dated this the 8th day of February, 2010\n\n                          JUDGMENT\n<\/pre>\n<p>      The petitioner, who was working as a Manager of the<\/p>\n<p>Ayyanthole Branch of the first respondent, has approached<\/p>\n<p>this Court complaining that she is being harassed and not<\/p>\n<p>permitted to work peacefully in her post. She has made a<\/p>\n<p>number of allegations in the Writ Petition against the<\/p>\n<p>second respondent who is alleged to be the person behind<\/p>\n<p>the harassment of the petitioner. During the pendency of<\/p>\n<p>the Writ Petition, by Ext.P10 order dated 19.1.2010, the<\/p>\n<p>petitioner has been transferred to the Irinjalakkuda<\/p>\n<p>Branch. Though she has been posted as a Manager, the<\/p>\n<p>petitioner complains that there is already a Manager there<\/p>\n<p>and since there is already a Manager posted there, she<\/p>\n<p>would not be able to work there peacefully as a Manager.<\/p>\n<p>According to the petitioner, there are 8 other Branches in<\/p>\n<p>Thrissur District where Senior Accountants are holding<\/p>\n<p>charge of the post of Manager. Therefore, the petitioner<\/p>\n<p>could have been posted to any one of the said places<\/p>\n<p><span class=\"hidden_text\">wpc No.37520\/2009        2<\/span><\/p>\n<p>   without causing any inconvenience.      According to the<\/p>\n<p>   petitioner, it is only due to the malafides of the second<\/p>\n<p>   respondent that she has not been posted to a suitable<\/p>\n<p>   place to hold independent charge as the Manager of a<\/p>\n<p>   branch.\n<\/p>\n<p>         2. The counsel for the first respondent on the other<\/p>\n<p>   hand refers to Ext.P10 to submit that the said proceedings<\/p>\n<p>   already contain instructions bifurcating the functions of<\/p>\n<p>   the Branch Manager in all branches where there is a<\/p>\n<p>   Senior Manager and Manager. Therefore, according to<\/p>\n<p>   the counsel, there is no reason for any problem or<\/p>\n<p>   confusion in Ext.P10.\n<\/p>\n<p>         3. It is conceded by the counsel for the petitioner<\/p>\n<p>   that the subject matter of this Writ Petition is one that<\/p>\n<p>   could be resolved by resorting to the remedy available<\/p>\n<p>   under Section 69 of the Kerala Co-operative Societies Act.<\/p>\n<p>   The petitioner has no objection in taking recourse to the<\/p>\n<p>   said remedy for redressing her grievances.<\/p>\n<p>         4. The counsel for the first respondent on the other<\/p>\n<p>   hand contends that there are no grievances for the<\/p>\n<p>   petitioner to be agitated under Section 69 of the Act. I do<\/p>\n<p><span class=\"hidden_text\">wpc No.37520\/2009       3<\/span><\/p>\n<p>   not propose to go into the said question in this Writ<\/p>\n<p>   Petition.\n<\/p>\n<p>         5.
