The\n\n injaterial on record would clearly show that the\n\nit   appellant had filed an application before the Workmerfs\n\nCompensation Commissioner, Mysore, seeking\n\n\\ ,\nx2'\n\n\n\n =  \n<\/pre>\n
compensation towards the injuries sustained by him<\/p>\n
during the course of employment on 16\/3\/2OD4:.fd_:’Fhe<\/p>\n
case of the appellant is that, he was workingiwithi <\/p>\n
respondent and he sustained injuries d\u00e9iringititiedtoourse<\/p>\n
of employment. He had injuriesV_to_t <\/p>\n
underwent surgical operationrin the NIMI%L%&N;?\u00a74’VHospita1V’<\/p>\n
and took treatmentvfor six;’rnodnth’saand’that”he joined<\/p>\n
service after taking rest   doctor.\n<\/p>\n
3.     the Workmen’s
\nCornpven.sat’i~o_n  Exs.P.1 to R6 were
\ngot  of the respondent, one
\nWitness   and Exs.D.1 to 13.3 were got<\/p>\n
 ‘ 4f\u00bb…v’1’h’e-,’Work1nen’s Compensation Commissioner,<\/p>\n
after  the contentions of the iearned counsel<\/p>\n
 appearing for the parties, by an order dated<\/p>\n
‘  1\/2006 held that the petitioner sustained injuries<\/p>\n
   the accident that occurred on 16\/ 3\/ 2004 arising out<\/p>\n
of and in the course of employment. However, having<\/p>\n

\\\/<\/p>\n
regard to the facts elicited in the cross~examinat_ion of _<\/p>\n
the appellant to the effect that now he is doing<\/p>\n
work as he was doing before the accident <\/p>\n
respondent and getting the sa.lai’fy*—.of  <\/p>\n
than the salary which he was  priorto the  V<\/p>\n
accident. The Workmeifs Corhpensati.on._C’oni’rnissioner,Vl<\/p>\n
held that the claimant has not l\\su._ffered””ari$z loss of
\nincome and accordinglyl:  petition since
\nthere was no”dis’abili_tygto~’award’-corifipensation. Being<\/p>\n
aggrieved     this’\u00bb.3a’ppea1 is filed.<\/p>\n
 =}}~lea.rd7fth:e.,llea;rh–ed’ counsel appearing for the
\nparties aridlseriitinizedilthe material on record.<\/p>\n
  Thelrriateried on record would clearly show that<\/p>\n
‘ ~.Co.mpeiisation Commissioner, has held that<\/p>\n
lappellantd\u00e9elaimant sustained injuries<\/p>\n
 on Ki’\/’\u00a33\/V2004 arising out of and in the course of<\/p>\n
 erriployment. However, it is speci\ufb01cally elicited in the<\/p>\n
  eross–examination of the claimant that he is doing the<\/p>\n
same work as he was doing earlier to the accident and<\/p>\n
‘M\/\\_\/&’<\/p>\n
that he is getting salary of Rs.3,000\/– more than the<\/p>\n
salary, which he was getting prior to the accid’ent–\u00ab.:an’d<\/p>\n
therefore, the petitioner has not sustained,.’::an.y <\/p>\n
income due to the injuries sustainec’.– in the_.acci..de11tTa1id<\/p>\n
the question of assessing the ”\n<\/p>\n
