SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/07\/2008 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>In<br \/>\n\tSpecial Civil Application No.21952 of 2007, the petitioners ?<br \/>\n\toriginal plaintiffs have prayed for appropriate writ, order and\/or<br \/>\n\tdirection, for quashing and setting aside the order dtd.12\/7\/2007<br \/>\n\tpassed by the learned Small Causes Court No.6, Ahmedabad  below<br \/>\n\tapplication Ex.95 in HRP Suit No.750 of 2004.\n<\/p>\n<p>In<br \/>\n\tSpecial Civil Application No.21954 of 2007, the petitioners ?<br \/>\n\toriginal plaintiffs have prayed for appropriate writ, order and\/or<br \/>\n\tdirection, for quashing and setting aside the order dtd.12\/7\/2007<br \/>\n\tpassed by the learned Small Causes Court No.6, Ahmedabad  below<br \/>\n\tapplication Ex.92 in HRP Suit No.750 of 2004.\n<\/p>\n<p>In<br \/>\n\tSpecial Civil Application No.21955 of 2007, the petitioners ?<br \/>\n\toriginal plaintiffs have prayed for appropriate writ, order and\/or<br \/>\n\tdirection, for quashing and setting aside the order dtd.23\/3\/2007<br \/>\n\tpassed by the learned Small Causes Court No.6, Ahmedabad  below<br \/>\n\tapplication Ex.81 in HRP Suit No.750 of 2004.\n<\/p>\n<p>It<br \/>\n\tis not in dispute that  while rejecting the aforesaid three<br \/>\n\tapplications, the learned Small Causes Court, Ahmedabad has<br \/>\n\tconsidered the order passed below application Ex.40. Learned<br \/>\n\tadvocates appearing on behalf of the respective parties have<br \/>\n\tsubmitted that the order passed below application Ex.40 was the<br \/>\n\tsubject matter of Special Civil Application 21952 of 2007 and the<br \/>\n\tlearned Single Judge of this Court (Coram ; D.N. Patel, J.) vide his<br \/>\n\tjudgement and order dtd.24\/8\/2007 has been pleased to allow the said<br \/>\n\tSpecial Civil Application by quashing and setting aside the order<br \/>\n\tpassed below application Ex.40 in so far as it was against the<br \/>\n\toriginal plaintiffs. It is also submitted by the learned advocate<br \/>\n\tappearing on behalf of the respective parties that the judgement and<br \/>\n\torder dtd.24\/8\/2007 passed by the learned Single Judge of this Court<br \/>\n\t  was challenged before the Hon&#8217;ble Supreme Court and the Hon&#8217;ble<br \/>\n\tSupreme Court has dismissed The Special Leave Petition confirming<br \/>\n\tthe aforesaid order passed by the learned Single Judge of this<br \/>\n\tCourt.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances  and in view of changed circumstances and allowing<br \/>\n\tapplication Ex.40 submitted by the petitioners ?  original<br \/>\n\tplaintiff by the learned Single Judge of this Court  vide judgement<br \/>\n\tand order dtd.24\/8\/2007, all the  orders impugned in these petitions<br \/>\n\tare required to be quashed and set aside and the matters are<br \/>\n\trequired to be remanded to the learned Small Causes Court for<br \/>\n\tdeciding all the aforesaid three applications afresh, in view of the<br \/>\n\tderangement and order passed by this Court in Special Civil<br \/>\n\tApplication 21953 of 2007 dtd.24\/8\/2007, by which the learned Single<br \/>\n\tJudge of this Court has allowed the application Ex.40.\n<\/p>\n<p>For<br \/>\n\tthe reasons stated above, the impugned orders passed by the learned<br \/>\n\tSmall Causes Court No.6, Ahmedabad below application Ex.Nos.95, 92<br \/>\n\tand 81 in HRP Suit No.750 of 2006 are hereby quashed and set aside<br \/>\n\tand the matters are remanded to the learned Small Causes Court,<br \/>\n\tAhmedabad  for deciding  the application Ex.Nos.95, 92 and 81<br \/>\n\tafresh in accordance with law and considering the judgement and<br \/>\n\torder passed by the learned Single Judge of this Court  in Special<br \/>\n\tCivil Application 21953 of 2007 dtd.24\/8\/2007. Learned advocate<br \/>\n\tappearing on behalf of the  respective parties to produce the copy<br \/>\n\tof the  judgement and order passed by the learned Single Judge of<br \/>\n\tthis Court  in Special Civil Application 21953 of 2007 dtd.24\/8\/2007<br \/>\n\tbefore the learned Small Causes Court, Ahmedabad for his<br \/>\n\tconsideration. Rule is made absolute accordingly.
