Shri \u00a0 Kailash \u00a0 Chand \u00a0 submitted \u00a0 RTI \u00a0 application\u00a0<br \/>\ndated \u00a0 31 \u00a0 May \u00a0 2010 \u00a0 before \u00a0 the \u00a0 CPIO, \u00a0 CBSC, \u00a0 Delhi\u00a0<br \/>\nrequesting \u00a0 for \u00a0 information \u00a0 pertaining \u00a0 to \u00a0 OMR \u00a0 sheet\u00a0<br \/>\nand\u00a0model\u00a0answer\u00a0sheet\u00a0for\u00a0AIEEE\u00a0exam\u00a02010\u00a0in\u00a0respect\u00a0<br \/>\nof\u00a0\u00a0his\u00a0son\u00a0Geet\u00a0Gupta.\u00a0The\u00a0CPIO\u00a0denied\u00a0disclosure\u00a0of\u00a0<br \/>\ninformation \u00a0 in \u00a0 his \u00a0 order \u00a0 dated \u00a0 2 \u00a0 July \u00a0 2010 \u00a0 on \u00a0 the\u00a0<br \/>\ngrounds\u00a0that\u00a0disclosure\u00a0did\u00a0not\u00a0serve\u00a0a\u00a0larger\u00a0public\u00a0<br \/>\ninterest \u00a0 and \u00a0 also \u00a0 informed \u00a0 that \u00a0 AIEEE \u00a0 answer \u00a0 sheets\u00a0<br \/>\nare\u00a0machine\u00a0treated\u00a0with\u00a0extreme\u00a0care\u00a0and\u00a0repeatedly\u00a0<br \/>\nscrutinised \u00a0 and \u00a0 that \u00a0 there \u00a0 is \u00a0 no \u00a0 provision \u00a0 for\u00a0<br \/>\nrechecking\/re\u00adevaluation \u00a0 of \u00a0 the \u00a0 answer \u00a0 sheets \u00a0 and\u00a0<br \/>\nrelied\u00a0on\u00a0Commission&#8217;s\u00a0judgment\u00a0dated\u00a023\u00a0April\u00a02007.\n<\/p>\n<p>2.    Applicant \u00a0 preferred \u00a0 appeal \u00a0 dated \u00a0 to \u00a0 July \u00a0 2010\u00a0<br \/>\nbefore \u00a0 the \u00a0 first \u00a0 appellate \u00a0 authority \u00a0 in \u00a0 which \u00a0 he\u00a0<br \/>\nstated \u00a0 that\u00a0his \u00a0son\u00a0had \u00a0expected \u00a0 263\u00a0marks \u00a0but\u00a0 that\u00a0<br \/>\nthe \u00a0board \u00a0had\u00a0awarded \u00a0him\u00a0only \u00a0208\u00a0 marks\u00a0 because \u00a0of\u00a0<br \/>\nwhich\u00a0his\u00a0son\u00a0has\u00a0suffered\u00a0shock\u00a0and\u00a0is\u00a0in\u00a0depression\u00a0<br \/>\nsince\u00a0the\u00a0declaration\u00a0of\u00a0the\u00a0results.\n<\/p>\n<p>3.    Vide \u00a0 order \u00a0 dated \u00a0 16 \u00a0 July \u00a0 2010, \u00a0 FAA \u00a0 upheld \u00a0 the\u00a0<br \/>\norder \u00a0 of \u00a0 the \u00a0 CPIO \u00a0 but \u00a0 informed \u00a0 the \u00a0 appellant \u00a0 that\u00a0<br \/>\neven \u00a0 though \u00a0 there \u00a0 was \u00a0 no \u00a0 provision \u00a0 for \u00a0 rechecking,\u00a0<br \/>\nafter \u00a0 taking \u00a0 approval \u00a0 of \u00a0 the \u00a0 Competent \u00a0 Authority \u00a0 of\u00a0<br \/>\nthe\u00a0Board\u00a0the\u00a0answer\u00a0sheet\u00a0in\u00a0respect\u00a0of\u00a0roll\u00a0number\u00a0<br \/>\n2620 \u00a0 4874 \u00a0 has \u00a0 been \u00a0 rechecked \u00a0 and \u00a0 the \u00a0 marks \u00a0 obtained\u00a0<br \/>\nby\u00a0the\u00a0candidate\u00a0are\u00a0found\u00a0to\u00a0be\u00a0correct.\n<\/p>\n<p> 4.    Not \u00a0 being \u00a0 satisfied \u00a0 by \u00a0 the \u00a0 above \u00a0 orders \u00a0 the\u00a0<br \/>\nappellant \u00a0 preferred \u00a0 second \u00a0 appeal \u00a0 before \u00a0 the\u00a0<br \/>\nCommission.\u00a0The\u00a0matter\u00a0was\u00a0heard\u00a0today.\u00a0Appellant\u00a0was\u00a0<br \/>\npresent \u00a0 at \u00a0 Jaipur \u00a0 and \u00a0 heard \u00a0 through\u00a0<br \/>\nvideoconferencing. \u00a0 Respondent \u00a0 was \u00a0 present \u00a0 in \u00a0 person\u00a0<br \/>\nas \u00a0 above. \u00a0 Appellant \u00a0 repeated \u00a0 that \u00a0 as \u00a0 per \u00a0 their \u00a0 own\u00a0<br \/>\ncalculation \u00a0 in \u00a0 consultation \u00a0 with \u00a0 experts, \u00a0 his \u00a0 son\u00a0<br \/>\nshould \u00a0 have \u00a0 been \u00a0 awarded \u00a0 higher \u00a0 marks. \u00a0 Respondent\u00a0<br \/>\nsubmitted \u00a0 copy \u00a0 of \u00a0 re\u00adevaluation \u00a0 sheet \u00a0 before \u00a0 the\u00a0<br \/>\nCommission \u00a0 as \u00a0 proof \u00a0 of \u00a0 the \u00a0 fact \u00a0 that \u00a0 as \u00a0 a \u00a0 special\u00a0<br \/>\ncase\u00a0the\u00a0answer\u00a0sheet\u00a0of\u00a0the\u00a0appellant&#8217;s\u00a0son\u00a0had\u00a0been\u00a0<br \/>\nrechecked. \u00a0 He \u00a0 however \u00a0 reiterated \u00a0 that \u00a0 as \u00a0 per \u00a0 the\u00a0<br \/>\nexisting\u00a0rules\u00a0and\u00a0on\u00a0the\u00a0basis\u00a0of\u00a0earlier\u00a0decisions\u00a0<br \/>\nof \u00a0 the \u00a0 Commission, \u00a0 there \u00a0 was \u00a0 no \u00a0 provision \u00a0 for\u00a0<br \/>\nproviding \u00a0 copy \u00a0 of \u00a0 OMR \u00a0 answer \u00a0 sheet \u00a0 of \u00a0 the \u00a0 model\u00a0<br \/>\nanswer\u00a0sheet\u00a0to\u00a0the\u00a0appellant.\n<\/p>\n<p>                              Decision\u00a0notice<\/p>\n<p>5.    After \u00a0 hearing \u00a0 both \u00a0 parties, \u00a0 Commission \u00a0 notes\u00a0<br \/>\nthat\u00a0respondent\u00a0has\u00a0confirmed\u00a0that\u00a0evaluation\u00a0of\u00a0the\u00a0<br \/>\n0MR\u00a0answer\u00a0sheets\u00a0is\u00a0carried\u00a0out\u00a0through\u00a0computerized\u00a0<br \/>\nprocess\u00a0and\u00a0not\u00a0manually.\u00a0It\u00a0is\u00a0also\u00a0established\u00a0 \u00a0as\u00a0<br \/>\nper\u00a0the\u00a0decision\u00a0of\u00a0the\u00a0CIC\u00a0in\u00a0Rakesh\u00a0Kumar\u00a0Singh\u00a0Vs\u00a0<br \/>\nHarish\u00a0Chander\u00a0that\u00a0where\u00a0OMR\u00a0sheets\u00a0are\u00a0used,\u00a0as\u00a0in\u00a0<br \/>\nthe\u00a0present\u00a0case,\u00a0the\u00a0disclosure\u00a0of\u00a0evaluated\u00a0answer\u00a0<br \/>\nsheet \u00a0 was \u00a0 &#8220;unlikely \u00a0 to \u00a0 render \u00a0 the \u00a0 system \u00a0 unworkable\u00a0<br \/>\nand\u00a0as\u00a0such\u00a0the\u00a0evaluated\u00a0answer\u00a0sheets\u00a0in\u00a0such\u00a0cases\u00a0<br \/>\nwill\u00a0be\u00a0disclosed\u00a0and\u00a0made\u00a0available\u00a0under\u00a0the\u00a0Right\u00a0<br \/>\nto \u00a0 Information \u00a0 Act \u00a0 unless \u00a0 providing \u00a0 such \u00a0 answer\u00a0<br \/>\nsheets\u00a0would\u00a0involve\u00a0an\u00a0infringement\u00a0of\u00a0copyright\u00a0as\u00a0<br \/>\nprovided\u00a0for\u00a0under\u00a0section\u00a09\u00a0of\u00a0the\u00a0RTI\u00a0Act&#8221;.\u00a0\u00a0\n<\/p>\n<p>6.     To\u00a0press\u00a0his\u00a0point,\u00a0appellant\u00a0has\u00a0relied\u00a0on\u00a0the\u00a0<br \/>\njudgement\u00a0of\u00a0\u00a0S.\u00a0Muralidhar,\u00a0J\u00a0in\u00a0W.P\u00a0(C)\u00a0751\u00a0of\u00a02011\u00a0<br \/>\nand\u00a0CM\u00a0Appl\u00a01598\/2011\u00a0filed\u00a0in\u00a0Delhi\u00a0High\u00a0Court\u00a0\u00a0which\u00a0<br \/>\nupheld \u00a0 the \u00a0 order \u00a0 of \u00a0 the \u00a0 Central \u00a0 information\u00a0<br \/>\nCommission \u00a0 dated \u00a0 23 \u00a0 December \u00a0 2010 \u00a0 \u00a0 in \u00a0 which\u00a0<br \/>\nCommission\u00a0directed\u00a0 \u00a0CPIO\u00a0of\u00a0the\u00a0Indian\u00a0Institute\u00a0of\u00a0<br \/>\nTechnology, \u00a0 Delhi \u00a0 to \u00a0 provide \u00a0 the \u00a0 mark \u00a0 sheet \u00a0 to \u00a0 the\u00a0<br \/>\nappellant.\u00a0Through\u00a0its\u00a0order\u00a0the\u00a0Court\u00a0has\u00a0ruled\u00a0that\u00a0<br \/>\n&#8220;the \u00a0 evaluation \u00a0 of \u00a0 the \u00a0 ORS \u00a0 is \u00a0 carried \u00a0 out \u00a0 through \u00a0<br \/>\ncomputerized \u00a0 process \u00a0 and \u00a0 not \u00a0 manually, \u00a0 the \u00a0 question \u00a0<br \/>\nof \u00a0 there \u00a0 being \u00a0 a \u00a0 fiduciary \u00a0 relationship \u00a0 between \u00a0 the \u00a0<br \/>\n IIT \u00a0 and \u00a0 the \u00a0 evaluators \u00a0 does \u00a0 not \u00a0 arise&#8230;.. \u00a0 and \u00a0 no \u00a0<br \/>\nprejudice \u00a0 can \u00a0 be \u00a0 caused \u00a0 to \u00a0 the \u00a0 IIT \u00a0 by \u00a0 providing \u00a0 a \u00a0<br \/>\ncandidate \u00a0 a \u00a0photocopy \u00a0 of \u00a0 the \u00a0 concerned \u00a0 0RS. \u00a0This \u00a0 is \u00a0<br \/>\nnot\u00a0information\u00a0being\u00a0sought\u00a0by\u00a0a\u00a0third\u00a0party\u00a0but\u00a0by \u00a0<br \/>\nthe \u00a0 candidate \u00a0 himself \u00a0 or \u00a0 herself. \u00a0 The \u00a0 disclosure \u00a0 of \u00a0<br \/>\nsuch \u00a0 photocopy \u00a0 of \u00a0 the \u00a0 0RS \u00a0 will \u00a0 not \u00a0 compromise \u00a0 the \u00a0<br \/>\nidentity \u00a0 of \u00a0 the \u00a0 evaluator, \u00a0 since \u00a0 the \u00a0 evaluation \u00a0 is \u00a0<br \/>\ndone\u00a0through\u00a0a\u00a0computerized\u00a0process.&#8221;\n<\/p>\n<p>7.    The \u00a0 Court \u00a0 also \u00a0 dismissed \u00a0 the \u00a0 argument \u00a0 that \u00a0 if\u00a0<br \/>\nthe\u00a0impugned\u00a0orders\u00a0of\u00a0the\u00a0CIC\u00a0are\u00a0sustained\u00a0it\u00a0would\u00a0<br \/>\nopen \u00a0 a \u00a0 &#8220;floodgate&#8221; \u00a0 of \u00a0 such \u00a0 applications \u00a0 by \u00a0 other\u00a0<br \/>\ncandidates \u00a0 as \u00a0 a \u00a0 result \u00a0 of \u00a0 which \u00a0 the \u00a0 entire \u00a0 JEE \u00a0 and\u00a0<br \/>\nGATE \u00a0 would \u00a0 &#8220;collapse&#8221; \u00a0 on \u00a0 the \u00a0 grounds \u00a0 that \u00a0 the\u00a0<br \/>\napprehension\u00a0is\u00a0exaggerated.\n<\/p>\n<p>8.   In \u00a0 keeping \u00a0 with \u00a0 the \u00a0 spirit \u00a0 and \u00a0 tone \u00a0 of \u00a0 the\u00a0<br \/>\naforementioned \u00a0 judgment, \u00a0 Commission \u00a0 directs \u00a0 the \u00a0 CPIO\u00a0<br \/>\nto\u00a0provide\u00a0a\u00a0copy\u00a0of\u00a0the\u00a0OMR\u00a0answer\u00a0sheet\u00a0and\u00a0model\u00a0<br \/>\nanswer\u00a0key\u00a0as\u00a0sought\u00a0by\u00a0the\u00a0appellant\u00a0within\u00a0one\u00a0week\u00a0<br \/>\nof\u00a0receipt\u00a0of\u00a0the\u00a0order.\u00a0\n<\/p>\n<p>9.
