     Petitioner who is Dietitian Grade-II in the Department<\/p>\n
of Health Services opted to be shifted to the Directorate of<\/p>\n
Medical Education. She submitted an option as per Ext.P2 in<\/p>\n
which she has also been asked to give her place of posting as<\/p>\n
per   preference.    While she has opted        for the Medical<\/p>\n
Education Department, in column No.14 relating to the<\/p>\n
stations required for posting (in the order of preference),<\/p>\n
she has shown only the Medical College Hospital, Kottayam.<\/p>\n
Though in the original draft list of persons whose options<\/p>\n
were to be accepted, as evidenced by Ext.P5, she has also<\/p>\n
been included, it seems that later she has been excluded<\/p>\n
there from as evidenced by Exts.P6 and P7 which are under<\/p>\n
challenge in this writ petition.\n<\/p>\n<\/p>\n
2.   Learned counsel for the respondents points out that it<\/p>\n
is quite possible that the preference shown by the petitioner<\/p>\n
for a station of posting namely the Medical College Hospital,<\/p>\n
Kottayam, could have been opted by any person, senior to<\/p>\n

\n                              2<\/span><\/p>\n
the petitioner, therefore, petitioner’s option may not have<\/p>\n
been accepted.\n<\/p>\n<\/p>\n
3.    Option is exercised in relation to the Department. If<\/p>\n
therefore,     an option by any person who is junior in the<\/p>\n
same post has been accepted in preference to the<\/p>\n
petitioner, then, the matter requires a verification and<\/p>\n
appropriate correction at the hands of the Government. The<\/p>\n
matter shall therefore be considered by the Government.<\/p>\n
4.    In the result,   petitioner may file a representation<\/p>\n
before the Government pointing out the above aspects<\/p>\n
within two weeks from today and the Government shall<\/p>\n
consider the request with reference to the following<\/p>\n
aspects.\n<\/p>\n<\/p>\n
     (i). Whether as per the guidelines which are<\/p>\n
     already relied on, the option exercised by an<\/p>\n
     incumbent is to be considered with reference to<\/p>\n
     the Department.\n<\/p>\n
     (ii). Whether the option by an incumbent to be<\/p>\n
     shifted to the Directorate of Medical Education is<\/p>\n

\n                               3<\/span><\/p>\n
     liable to be rejected, if the station for posting<\/p>\n
     given by the incumbent has already been opted<\/p>\n
     for by any other senior incumbent as such.<\/p>\n
5.    Government      shall   take    a   decision  on  the<\/p>\n
representation after notice to the affected persons within<\/p>\n
four weeks from the date of receipt of a copy of this<\/p>\n
judgment. Petitioner shall be retained in the present place<\/p>\n
of posting till the Government takes a decision. It is made<\/p>\n
clear   that orders passed by the Department of       Health<\/p>\n
Services, consequent upon the acceptance of options from<\/p>\n
different persons in the Health Services Department can be<\/p>\n
operated upon and the fact that the petitioner is being<\/p>\n
permitted to be retained in the present place of posting<\/p>\n
shall not stand in the way of operation of such orders.<\/p>\n
      Writ petition is disposed of as above.<\/p>\n
