The  writ petition was  filed<br \/>\nchallenging the order  dated 16th May, 2008, passed by the<br \/>\nlearned Additional Senior Civil Judge, Surat,  in Regular Civil Suit<br \/>\nNo. 506 of 1996.  By the said order, the learned Civil Judge,  in<br \/>\nexercise of powers  under Order-1 Rule 10 of the Code of Civil<br \/>\nProcedure,  directed   the plaintiff to join all male descendants<br \/>\nupto three  generation and further directed to join illegitimate<br \/>\nchildren of his father  Manilal.  The appellants &#8211; original<br \/>\ndefendants No. 7 to 12 in the suit and all of whom  are co-parceners<br \/>\nin the  joint family,  were  aggrieved by the order passed by the<br \/>\nlearned  Civil  Judge. They had therefore preferred  the above<br \/>\nmentioned petition.\n<\/p>\n<p>2\t\tThe<br \/>\nlearned Single Judge, after taking into consideration  all the<br \/>\ncontentions raised by the petitioners,  by detailed judgment,<br \/>\nturned down the petition, which judgment is under challenge before<br \/>\nthis Court  in the present appeal.\n<\/p>\n<p>3\t\tWe<br \/>\nfind that the learned Civil Judge exercising  the discretionary<br \/>\npowers  had ordered joining of certain defendants  as necessary<br \/>\nparties  in the suit.  Learned Single Judge, after examining  the<br \/>\norder  passed by learned Civil Judge, has  refused to interfere with<br \/>\nthe discretionary exercise of powers by the Civil Judge.  We  see no<br \/>\nreason to interfere  with the orders under challenge. Further, we<br \/>\nfind that  the suit is  pending since 1996 and we desire that  the<br \/>\nsame comes to an end  at the earliest.\n<\/p>\n<p>4\t\tIn<br \/>\nview of above facts and circumstances, without interfering with the<br \/>\norders passed by the learned Single Judge as well as the learned<br \/>\nCivil Judge,  it is directed that the pending Civil Suit, being<br \/>\nRegular Civil Suit No. 506 of 1996,  be disposed of  by the learned<br \/>\nCivil Judge as early as possible  and preferably within six months<br \/>\nfrom the receipt of order of this Court.  Both the sides shall<br \/>\ncooperate with the Civil Court in bringing an early end to the suit.<br \/>\nIt is further clarified   that the suit shall be decided  on the<br \/>\nevidence that may be brought  on record  and all defences  shall be<br \/>\nopen to the present appellants.\n<\/p>\n<p>5\t\tWith<br \/>\nthe aforesaid observations, the Letters Patent Appeal stands disposed<br \/>\nof.  Civil Application  also stands disposed of.
