The Deputy Inspector General (Incharge Karmik), Bihar, Patna\n                                            -----------\n<\/pre>\n<p>3.   13.09.2011                 Heard learned counsel for the petitioners<\/p>\n<p>                  and the State.\n<\/p>\n<p>                                The claim in the writ application is to<\/p>\n<p>                  appoint the petitioners on the post of Constable after<\/p>\n<p>                  setting aside the order of the D.I.G. (Personnel) dated<\/p>\n<p>                  2.4.2008 denying them that relief notwithstanding<\/p>\n<p>                  the directions of this Court in C.W.J.C. No. 5723 of<\/p>\n<p>                  2005.\n<\/p>\n<p>                                It is submitted that as a Home Guards they<\/p>\n<p>                  were entrusted with patrolling duty and engaged<\/p>\n<p>                  with    the     unlawful   elements   leading   to   active<\/p>\n<p>                  discharge of duty by the petitioners in apprehending<\/p>\n<p>                  persons.      The D.I.G. recommended in 1993 to<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>recognize their efforts. In C.W.J.C. No. 5723 of 2005<\/p>\n<p>this Court directed the respondents to dispose the<\/p>\n<p>representation.       The impugned order does not<\/p>\n<p>recognize the exemplary service rendered by the<\/p>\n<p>petitioners wrongly denying them the right to<\/p>\n<p>appointment.\n<\/p>\n<p>          No counter affidavit has been filed by the<\/p>\n<p>respondents. Counsel for the State submits that any<\/p>\n<p>appointment in    Police service is regulated by the<\/p>\n<p>Police manual and Article 14 of the Constitution of<\/p>\n<p>India.   Appointment can only be made by open<\/p>\n<p>advertisement and competitive merit selection. The<\/p>\n<p>petitioner cannot be considered for appointment in<\/p>\n<p>the manner desired as reasoned in the impugned<\/p>\n<p>order dated 2.4.2008.\n<\/p>\n<p>          The impugned order, in the opinion of this<\/p>\n<p>Court, rightly records that the claim for appointment<\/p>\n<p>in the manner made was not sustainable.         If the<\/p>\n<p>petitioners were engaged as a Home Guard on patrol<\/p>\n<p>duty when they engaged with the unlawful elements<\/p>\n<p>they did not do the State a favour. They did<\/p>\n<p>themselves a favour by discharge of their duties to<\/p>\n<p>enable them to earn their salary. That will not vest a<\/p>\n<p>claim in them for appointment contrary to Article 14<\/p>\n<p>of the Constitution.\n<\/p>\n<p><span class=\"hidden_text\">                              3<\/span><\/p>\n<p>                     If the respondents issue an Advertisement<\/p>\n<p>           and the petitioners respond to the same they may be<\/p>\n<p>           considered in accordance with law and subject to<\/p>\n<p>           any policy decision in the matter the respondents<\/p>\n<p>           may consider preference in light of past services if<\/p>\n<p>           they deem it fit and proper.\n<\/p>\n<p>                     The writ application is disposed.\n<\/p>\n<\/p>\n<pre>P.
