The petitioner filed<\/p>\n<p>izhgill\u00e9ixging the said order in appeal N0.?.Oi2\u20ac)i}4 before<br \/>\n Appeiiaie Tribunai (for short &#8216;Tn&#8217;b%unaI&#8217;),<\/p>\n<p>&#8216;V  *   The Tribunai after considering the rival centemions ef<\/p>\n<p>K<\/p>\n<p><span class=\"hidden_text\">2233<\/span><\/p>\n<p>the parties, has ciismissed the agpeai by its order daied 4.82006<\/p>\n<p>(Annexure &#8216;AA&#8217;).\n<\/p>\n<p>3. leaned Ccrunsel for the petitioner contends <\/p>\n<p>petitioner was not well from 20.1.2003 to 3e.:_2003.%%%i\u00ab1e%\ufb01at&#8217;<br \/>\nsubmitted leave letters along with med\u00e9cal.;ee:ti\ufb01&#8217;ca1.\u00a7\u00e9?.\u00a7.&#8221;&#8216;\u00a7i\ufb01%\u00e9\u00a7*\u00a2\u00a7?\u00e9;$ .:<br \/>\nthe management did not gram leave. On   : <\/p>\n<p>petitioner wanted to attend to his hf:  not  Vic&#8221;:<\/p>\n<p>enter the  to permit him to<br \/>\nresume the cfuiy  n0:V&#8221;rs\u00a7\u20acst1It. He has eavmplained to the<\/p>\n<p>Joint Directer as \ufb01e:  can 21.7.2003 in this regard. The<\/p>\n<p>jam;  saint&#8217; a n\u00a7i:ce&#8217;as per Armexare &#8216;Z&#8217; dated 3&#8217;12.2@o4<\/p>\n<p> jn\ufb01\ufb01agenaent to Show cause as to how the<\/p>\n<p>  ma;1agA:m_\u00a7e:I\u00a7&#8221;.:E\u00a2iA3V;imed salary of the petitioner from &#8217;20.}.2(}03<br \/>\n&#8221;   thouga according to the managament he was<br \/>\n  absent, amng the said perio\u00e9. It is submiiied tfzat<br \/>\n  sgzquiry officer has erreneously held that the charges have been<\/p>\n<p>fafeve\u00e9. The enquiry o\ufb01ieefs repo\ufb01 has been accepted by the<\/p>\n<p>diseipiinary authority. The Tribunal without noticing the relevante-__<\/p>\n<p>materials on record such as the attendance register has eon\ufb01mrei\u00e9ie<\/p>\n<p>the order. It is submitted that the orders impugned are     <\/p>\n<p>nature. It is \ufb01xriher argued that the inazzagezne\ufb01fbefare &#8220;\u00a7a.es\u00e9&#8217;3{:Ag:vti_;eV: -.  <\/p>\n<p>order as per Annexure &#8216;U&#8217; dated 8.&#8217;?&#8217;.2{}O4 has\u00bbAiiet pe\ufb01gteiss\u00e9on &#8221;  <\/p>\n<p>ofthe competent authority as per seeond\ufb01f\u00e9viso   ei&#8221;: <\/p>\n<p>Kamataka Educ-atioaal Instimtiiiizg (Ceiiegieie i\u00a7;d;:eatieii)&#8221;&#8216;Ru&#8217;Ies,<br \/>\n2003 (_&#8217;Rules&#8217; for short). Rule 32 ::&#8217;rc~$fides &#8216;i&#8217;:)_1&#8243;&#8221;&#8216;:h\u00a7:   u<\/p>\n<p>penaities, which may be imposed for  feas\u00e9ns<br \/>\n{mthe employees.
