RAVIKUMAR, J\n          - - - - - - - - - - - - -- - - - - - - - - - - - - - - -\n                  W.P.(C)No. 34218 OF 2010\n          - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n\n       Dated this the 19th day of November, 2010\n\n\n                          J U D G M E N T\n<\/pre>\n<p>           The petitioner is the registered owner of a stage<\/p>\n<p>carriage bearing registration No. KL 13\/J 254.                    The said<\/p>\n<p>vehicle  is   hypothecated         with     the    second       respondent.<\/p>\n<p>According to the petitioner the entire loan amount has been<\/p>\n<p>repaid  and     thereupon,        for    getting     the     hypothecation<\/p>\n<p>termination letter for the purpose of cancellation of the<\/p>\n<p>hypothecation endorsement in the registration certificate she<\/p>\n<p>has already approached the second respondent.                      In fact,<\/p>\n<p>Ext.P3 is the letter issued to the second respondent carrying<\/p>\n<p>the said request. The letter has been returned unclaimed.<\/p>\n<p>Thereupon, the petitioner approached the first respondent by<\/p>\n<p>filing Ext.P4 application for cancellation of hypothecation.<\/p>\n<p>According to the petitioner, in terms of the provisions under<\/p>\n<p>section 51(7) of the Motor Vehicle Act, the first respondent<\/p>\n<p>should have taken appropriate steps for cancelling the<\/p>\n<p>hypothecation endorsement in the registration certificate.<\/p>\n<p>This writ petition has been filed on being aggrieved by the<\/p>\n<p>WPC.No.34218\/2010<br \/>\n<span class=\"hidden_text\">                              : 2 :<\/span><\/p>\n<p>inaction on the part of the first respondent in taking<\/p>\n<p>appropriate steps on Ext.P4.\n<\/p>\n<p>      I have heard the learned counsel for the petitioner as<\/p>\n<p>also   the   learned    Government    Pleader.    The    learned<\/p>\n<p>Government Pleader submits that Ext.P4 application will be<\/p>\n<p>considered by the first respondent after issuing notice to the<\/p>\n<p>second respondent. This is recorded. Accordingly, this writ<\/p>\n<p>petition is disposed of with a direction to the first respondent<\/p>\n<p>to   consider    Ext.P4   application    for  cancellation    of<\/p>\n<p>hypothecation endorsement in the registration certificate<\/p>\n<p>pertaining to the vehicle bearing No. KL 13\/J 254, in<\/p>\n<p>accordance with law, with notice to the second respondent as<\/p>\n<p>well. This shall be done expeditiously, at any rate, within a<\/p>\n<p>period of one month from the date of receipt of a copy of this<\/p>\n<p>judgment.\n<\/p>\n<\/p>\n<p>                                      Sd\/-<\/p>\n<pre>\n                                  (C.T.
