The present petition has been preferred mainly ventilating a<br \/>\ngrievance that the respondents are not giving electricity connection<br \/>\nto the petitioner for the premises which has been purchased by the<br \/>\npetitioner vide Registered Sale Deed document dated 24.10.2003<br \/>\nunder the pretext that predecessor entitle has not paid electricity<br \/>\nbill and therefore, new connection to the petitioner is denied.<br \/>\nAgainst this action of the respondents, the present petition has<br \/>\nbeen preferred.\n<\/p>\n<p>2.    Having heard counsel for both the sides and looking to the<br \/>\nfacts and circumstances, it appears that :-\n<\/p>\n<blockquote><p>      (i)     That the petitioner has purchased the properties by<br \/>\n              Registered Sale Deed dated 24.10.2003 from his<br \/>\n              predecessor-in-title.\n<\/p><\/blockquote>\n<blockquote><p>      (ii)    It also appears from the facts of the case that the<br \/>\n              petitioner applied for fresh electricity connection in<br \/>\n              his   own   name.       Necessary charges   for getting<br \/>\n              reconnection have also been paid to the respondents<br \/>\n              on 18.11.2006. Despite this, the electricity connection<br \/>\n              has not been supplied by the respondents.\n<\/p><\/blockquote>\n<blockquote><p>      (iii)   It appears from the contentions by the counsel for the<br \/>\n              respondents that there are dues to be paid by the<br \/>\n              petitioner towards electricity charges. It also appears<br \/>\n              from the facts of the case that no electricity has been<br \/>\n              supplied to the petitioner and therefore, there are no<br \/>\n              dues of the petitioner. Thus, it appears that these are<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>       dues of the predecessor-in-title, towards consumption<br \/>\n       of electricity which was consumed by him.\n<\/p><\/blockquote>\n<p>(iv)   It also appears from the facts of the case that the<br \/>\n       petitioner has not accepted the liability of the<br \/>\n       predecessor-in-title for the payment of the electricity<br \/>\n       dues. Counsel for the respondent is unable to point<br \/>\n       out any clause of any agreement or any letter written<br \/>\n       by the petitioner to the respondents accepting the<br \/>\n       liability towards electricity charges of his predecessor-<br \/>\n       in-title.\n<\/p>\n<p>(v)    It also appears that the respondent Board is imposing<br \/>\n       a liability of predecessor-in-title upon the present<br \/>\n       petitioner. This is not permissible in the eye of law.\n<\/p>\n<p>(vi)   It has been submitted by the counsel for the petitioner<br \/>\n       that as per Electricity Supply Code, 2005 enacted<br \/>\n       under the provisions of the Electricity Act, 2003,<br \/>\n       Clause 5.1 reads as under :-\n<\/p>\n<p>5. Requisition for supply :\n<\/p>\n<p>       5.1 Requisition for a new supply of electricity shall be<br \/>\nmade by the owner\/occupier of the premises in duplicate in<br \/>\nthe prescribed form of the licensee which shall be available<br \/>\nat a cost from the local office of the licensee. The model<br \/>\nformat of the application form is provided in Schedules-I<br \/>\nand II of these Regulations. The license shall necessarily<br \/>\nsupply two copies of agreement format, one copy of tariff<br \/>\nschedule and one copy of Electricity Supply Code along with<br \/>\nthe application forms. Copies of application form and other<br \/>\nnecessary required documents as mentioned above down<br \/>\nloaded from the website of licensee may also be used by<br \/>\napplicant and shall be accepted by the licensee.\n<\/p>\n<p>       On the application form there shall be clearly<br \/>\nmentioned the names and address form where the<br \/>\napplication form can be obtained and where the application<br \/>\nform can be obtained and where the filled up application<br \/>\nform will be submitted.\n<\/p>\n<p><span class=\"hidden_text\">                         3<\/span><\/p>\n<p>      Any assistance or information required in filling up<br \/>\nthe form will be provided to the applicant at the local office<br \/>\nof the licensee.\n<\/p>\n<p>5.2   The application shall indicate in the application for<br \/>\nelectricity supply his full name and address (permanent if<br \/>\nany) with telephone number and also detail address of the<br \/>\npremises for which requisition of supply has been made<br \/>\nincluding Khata No., Khesra No., Municipal holding No.,<br \/>\nhouse (Plot No. etc. as applicable). The applicant shall also<br \/>\nprovide     following        information&#8217;s\/particulars       in   the<br \/>\napplication :\n<\/p>\n<blockquote><p>      (a)       Name and address of the licensed Electricity<br \/>\n                contractor         through        whom            the<br \/>\n                wiring\/installation will be\/have been carried<br \/>\n                out.\n<\/p><\/blockquote>\n<blockquote><p>      (b)       Purpose of usages of electricity and load for<br \/>\n                each such usage.\n<\/p><\/blockquote>\n<blockquote><p>      (c)       Whether application is for new connection,<br \/>\n                temporary     connection,    shifting   of   service,<br \/>\n                additional load, change of name or change of<br \/>\n                type (category) of service(tariff).\n<\/p><\/blockquote>\n<blockquote><p>      (d)       Whether the applicant wants to carry out the<br \/>\n                works of laying service line and\/or dedicated<br \/>\n                distribution facility for the electricity supply<br \/>\n                requisitioner.\n<\/p><\/blockquote>\n<p>5.3   The applicant shall furnish along with application for<br \/>\nrequisition of electricity supply following documents :\n<\/p>\n<blockquote><p>      (a)       Two photographs affixed one each in the<br \/>\n                duplicate copies of the application form.\n<\/p><\/blockquote>\n<blockquote><p>      (b)       Proof of legal occupancy in the form of copies of<br \/>\n                sale-deed or partition deed or succession<br \/>\n                certificate or power-or-attorney or lease\/rent<br \/>\n                agreement or allotment order or in case of<br \/>\n                agricultural connection &#8220;Khata nakal&#8221; giving<br \/>\n                Khesar No.<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<\/blockquote>\n<blockquote><p>            (c)     In case of a partnership firm, partnership deed,<br \/>\n                    authorization in the name of the applicant for<br \/>\n                    signing the requisition form and agreement.<\/p><\/blockquote>\n<pre>\n            (d)     In case of public and\/or private limited\n                    company,    Memorandum        and    Articles   of\n<\/pre>\n<blockquote><p>                    Association and Certificate of incorporation<br \/>\n                    together, with an authorization in the name of<br \/>\n                    the applicant for signing the requisition form<br \/>\n                    and agreement.<\/p><\/blockquote>\n<p>      In view of the aforesaid provisions also, no liability of the<br \/>\npredecessor-in-title can be fasten upon the present petitioner.\n<\/p>\n<p>      (vii) It has also been held by the Hon&#8217;ble Supreme Court in<br \/>\n            the case of Isha Marbles Vs. Bihar State Electricity<br \/>\n            Board and Anr. reported in 1995(2) SCC 648 especially<br \/>\n            in paragraph Nos. 61, 62 and 63 reads as under :-\n<\/p>\n<p>            &#8220;61. What we have discussed above appears to be the<br \/>\n            law gatherable from the various provisions which we<br \/>\n            have detailed out above. It is impossible to impose on<br \/>\n            the purchasers a liability which was not incurred by<br \/>\n            them.\n<\/p>\n<p>            62. No doubt, from the tabulated statement above set<br \/>\n            out, the auction-purchasers came to purchase the<br \/>\n            property after disconnection but they cannot be<br \/>\n            &#8220;consumer or occupier&#8221; within the meaning of the<br \/>\n            above provisions till a contract is entered into.\n<\/p>\n<p>            63. We are clearly of the opinion that there is great<br \/>\n            reason and justice in holding as above. Electricity is<br \/>\n            public property. Law, in its majesty, benignly protects<br \/>\n            public property and behoves everyone to respect<br \/>\n            public property. Hence, the courts must be zealous in<br \/>\n            this regard. But, the law, as it stands, is inadequate to<br \/>\n            enforce the liability of the previous contracting party<br \/>\n            against the auction-purchaser who is a third party and<br \/>\n<span class=\"hidden_text\">                                             5<\/span><\/p>\n<p>                           is   in     no   way   connected    with    the   previous<br \/>\n                           owner\/occupier. It may not be correct to state, if we<br \/>\n                           hold as we have done above, it would permit<br \/>\n                           dishonest consumers transferring their units from one<br \/>\n                           hand to another, from time to time, infinitum without<br \/>\n                           the payment of the dues to the extent of lakhs and<br \/>\n                           lakhs of rupees and each one of them can easily say<br \/>\n                           that he is not liable for the liability of the predecessors<br \/>\n                           in interest. No doubt, dishonest consumers cannot be<br \/>\n                           allowed to play truant with the public property but<br \/>\n                           inadequacy of the law can hardly be a substitute for<br \/>\n                           overzealousness&#8221;.\n<\/p>\n<p>                                                      (Emphasis supplied)<br \/>\n                                     The aforesaid judgement has also been followed<br \/>\n                           in the subsequent judgements rendered by the<br \/>\n                           Hon&#8217;ble Supreme Court which is binding to the<br \/>\n                           respondent Electricity Board.\n<\/p>\n<p>                  (viii)             In view of the aforesaid decision also, no<br \/>\n                           liability of the predecessor-in-title of dues of electricity<br \/>\n                           can be imposed upon a purchaser of the property<br \/>\n                           especially when no such liability has been accepted by<br \/>\n                           the subsequent purchaser.\n<\/p>\n<p>            3.    As cumulative effect of the aforesaid facts, reasons and<br \/>\n            judicial pronouncements, no liability of the predecessor-in-title can<br \/>\n            be imposed upon the petitioner for the payment of electricity dues<br \/>\n            and therefore, if there is no other objection for grant of fresh<br \/>\n            electricity connection to the petitioner, the respondents are hereby<br \/>\n            directed to give fresh &#8211; new electricity connection forthwith in the<br \/>\n            name of the petitioner upon receiving necessary charges towards<br \/>\n            fresh &#8211; new electricity connection without levying predecessor-in-<br \/>\n            title&#8217;s dues from the petitioner.\n<\/p>\n<p>                  Petition is allowed and disposed of.\n<\/p>\n<p>                                                                  (D.N.
