Justice K.HEMA\n\n Dated :31\/05\/2010\n\n O R D E R\n                                 K.HEMA, J\n                              --------------------\n                  Bail Application No.279 Of 2010\n                -------------------------------------------------\n                Dated this the 31st day of May 2010\n\n                                   ORDER\n<\/pre>\n<p>     This petition is for anticipatory bail.<\/p>\n<p>     2. The alleged offences are under Sections 452, 323, 324,<\/p>\n<p>427, 294(b) and read with Section 34 of the IPC.                  According to<\/p>\n<p>prosecution, petitioners (A1 and A2) in furtherance of their<\/p>\n<p>common intention trespassed into the house of the de facto<\/p>\n<p>complainant and assaulted her and her husband and also<\/p>\n<p>destroyed articles in the house. First accused used a sword and<\/p>\n<p>the de facto complainant and her husband sustained injuries.<\/p>\n<p>     3.   Learned counsel for the petitioner submitted that no<\/p>\n<p>incident as alleged had taken place.                 De facto complainant&#8217;s<\/p>\n<p>husband was drunk on the date of occurrence and he was taken to<\/p>\n<p>his house by the petitioners. On reaching house,                     de facto<\/p>\n<p>complainant did not like it and she alleged that the petitioners<\/p>\n<p>were responsible for making her husband drink.                     There was<\/p>\n<p>altercation between the two and in the course of the incident, the<\/p>\n<p>de facto complainant sustained some minor injuries. The parties<\/p>\n<p>are relatives.\n<\/p>\n<p><span class=\"hidden_text\">Bail Application No.279 Of 2010        2<\/span><\/p>\n<p>       4.     This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that the de facto complainant&#8217;s husband used to get<\/p>\n<p>drunk and de facto complainant believed that the petitioners were<\/p>\n<p>responsible for the same. This fact was brought to the notice of<\/p>\n<p>the petitioners while they attacked de facto complainant&#8217;s<\/p>\n<p>husband and pushed him down into a canal. After this incident,<\/p>\n<p>again, they trespassed into the house of the de facto complainant<\/p>\n<p>through the back door and inflicted injuries and committed<\/p>\n<p>mischief etc.<\/p>\n<p>       5. On hearing both sides, considering the serious nature of<\/p>\n<p>the allegation made, nature of the injuries sustained and the<\/p>\n<p>place where the incident happened, I am satisfied that this is not<\/p>\n<p>a fit case to grant anticipatory bail.
