Justice P.S.GOPINATHAN\n\n Dated :17\/03\/2009\n\n O R D E R\n               P.R.RAMAN &amp; P.S.GOPINATHAN, JJ.\n\n                    -------------------------------\n\n                        W.A.No.645 of 2009\n\n                    -------------------------------\n\n                  Dated this the 17th March, 2009\n\n                          J U D G M E N T\n<\/pre>\n<p>Raman, J.\n<\/p>\n<\/p>\n<p>               As against the imposition of penalty, the appellant<\/p>\n<p>had already invoked the appellate remedy before the Deputy<\/p>\n<p>Commissioner of Appeals and also filed a stay petition. Earlier,<\/p>\n<p>he had filed a writ petition, W.P.(C) No.37256 of 2008, and this<\/p>\n<p>Court has directed to dispose of the stay petition filed before the<\/p>\n<p>appellate authority and the appellate authority has also granted a<\/p>\n<p>stay. The appellant has again come up before this Court by filing<\/p>\n<p>the present writ appeal challenging the very same penalty order,<\/p>\n<p>which he has already challenged in the appeal. According to him,<\/p>\n<p>the penalty imposed is without jurisdiction, which contention, he<\/p>\n<p>can raise before the Deputy Commissioner of Appeals. Appellate<\/p>\n<p>authority is also competent to grant          relief to him on such<\/p>\n<p>ground, if it is proved that the order is passed without any notice<\/p>\n<p>to him.        The learned Single Judge, in such circumstances,<\/p>\n<p>WA.No.645 OF 2009<\/p>\n<p><span class=\"hidden_text\">                            2<\/span><\/p>\n<p>relegated the petitioner to pursue his remedies  before the<\/p>\n<p>appellate authority.   We do not find any error in the order<\/p>\n<p>passed by the learned Single Judge.
