No.1068 of 2011\n                          NARESH DAS, SON OF YOGESHWAR DAS\n                                            Versus\n                                 THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>02    14.02.2011               Heard learned counsel for the petitioner as well<\/p>\n<p>                    as learned Public Prosecutor for the State.<\/p>\n<p>                                  Petitioner seeks his bail in connection with<\/p>\n<p>                    Excise Case No. 19 of 2010 for the offence punishable under<\/p>\n<p>                    Section 47A of the Excise Act.\n<\/p>\n<p>                                  Admittedly, petitioner is the owner of the truck<\/p>\n<p>                    from which 3000 litres illicit liquor were recovered.<\/p>\n<p>                    Admittedly, the aforesaid truck had been found parked in front<\/p>\n<p>                    of the house of brother of this petitioner and initially the<\/p>\n<p>                    brother of the petitioner was made accused and when the<\/p>\n<p>                    petitioner filed release petition before the concerned court, the<\/p>\n<p>                    petitioner has been made accused in this case.<\/p>\n<p>                                  Considering      the    aforesaid     facts    and<\/p>\n<p>                    circumstances as well as submissions of the parties, above<\/p>\n<p>                    named petitioner is directed to be released on bail on<\/p>\n<p>                    furnishing bail bonds of Rs. 10,000\/- (Ten Thousand) with two<\/p>\n<p>                    sureties of the like amount each to the satisfaction of Chief<\/p>\n<p>                    Judicial Magistrate, Samastipur in connection with above<\/p>\n<p>                    stated Excise Case No. 19 of 2010.\n<\/p>\n<\/p>\n<pre>Shahzad                                  (Hemant Kumar Srivastava, J )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Naresh Das vs The State Of Bihar on 14 February, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
