JUSTICE<br \/>\nR.M.DOSHIT)<\/p>\n<p>\tThis<br \/>\nApplication under Section 5 of the Limitation Act is filed by the<br \/>\nappellant for condonation of delay of 189 days occurred in filing the<br \/>\nabove Letters Patent Appeal.\n<\/p>\n<p>\tBy<br \/>\norder dated 23rd September 2005 (Coram : Mr. Justice G.S.<br \/>\nSanghvi, as he then was and Mr. Justice P.B. Majumdar), the<br \/>\napplicant was directed to file proper affidavit in support of the<br \/>\napplication.  Till this date, the supporting affidavit is not placed<br \/>\non record.  Learned advocate Mr. Vicky Mehta admits that the<br \/>\napplicant has not come forth to make further affidavit.\n<\/p>\n<p>\tThough<br \/>\nthe delay in filing the appeal is that of 189 days, this Application<br \/>\nhas come up for hearing before us more than 5 years after the date of<br \/>\nfiling.  We have, therefore, considered it expedient to hear the<br \/>\nmatter on merits to ascertain whether or not the appellant has made<br \/>\nout a prima facie case.\n<\/p>\n<p>\tThe<br \/>\nappellant   writ petitioner was appointed as a Peon in the office<br \/>\nof the District Inspector of Land Records, Panchmahals.  His service<br \/>\nwas seasonal in as much as during the four months of monsoon, when<br \/>\nthe field work is not in operation, his service is terminated.  The<br \/>\nappellant, therefore, filed above Special Civil Application<br \/>\nNo.2921\/1998 for direction to give permanent appointment to the<br \/>\nappellant and to set aside the order of termination of service. Let<br \/>\nit be noted that the order of termination of service is not placed on<br \/>\nrecord.\n<\/p>\n<p>\tThe<br \/>\nquestion of continuous service of seasonal peons in the office of<br \/>\nDistrict Inspector of Land Records has come up before this Court in<br \/>\nseveral other matters.  One of such matters (Special Civil<br \/>\nApplication No.2603\/1982) came up before the Division Bench of this<br \/>\nCourt (Coram : R.K. Abhichandani and D.H. Waghela, JJ).  By judgment<br \/>\nand order dated 7th<br \/>\nMarch 2000, the said petition was dismissed. The Court observed,  we<br \/>\nhave no doubt that course of absorbing eight monthly peons in all<br \/>\nvacant post of full time peons which was promised under the affidavit<br \/>\nin reply must have been benefitted all of the petitioners by now.<br \/>\nHowever, the petitioners could not have claimed such absorption as a<br \/>\nmatter of right.  The petition is therefore rejected .  Following<br \/>\nthe said Division Bench judgment, the learned single Judge has<br \/>\ndismissed the above petition filed by the appellant.\n<\/p>\n<p>\tWe<br \/>\nagree with the decision of the Division Bench and consequently of the<br \/>\nlearned Single Judge.  In our view,<br \/>\nthe Appeal is devoid of any merit.  Moreover, in view of the passage<br \/>\nof 22 years since filing of the writ petition, the cause of action<br \/>\nmay not survive.  The present Application under Section 5 of the<br \/>\nLimitation Act circulated for orders more than 5 years after the date<br \/>\nof filing need not be entertained.\n<\/p>\n<p>\tFor<br \/>\nthe aforesaid reason, the Application is rejected.  Registration of<br \/>\nthe Letters Patent Appeal (Stamp) No.288 of 2005 and the Civil<br \/>\nApplication (Stamp) No.1674 of 2005 is refused.\n<\/p>\n<p> (M.D.\n<\/p>\n<pre>Shah, J.)\t\t\t\t(Ms. R.M.
