The Secretary to Government,\n    Prohibition and Excise Dept.,\n    Fort St.George, Chennai 9       Respondents\n\n        Petition under Article 226  of  the  Constitution  of  India  for  the\nissuance  of  a Writ of Habeas Corpus to direct the respondents to produce the\npetitioner's husband Babu son of Krishnan male aged 27 years and now  confined\nat  Central Prison, Chennai and call for the records set him liberty forthwith\nand set aside the order of detention vide No.5 3\/BDFGISV\/2006 dated  13.2.2006\non the file of 2nd respondent.\n\n!For Petitioner :  Dr.G.Krishnamurthy\n\n^For Respondents:  Mr.Babu Muthu Meeran   \n                   Addl.  Public Prosecutor\n\n:ORDER  \n<\/pre>\n<p>                (Order of the Court was made by V.Dhanapalan, J.)<\/p>\n<p>        The  petitioner,  who  is the wife of the detenu by name Babu, who was<br \/>\ndetained as a &#8221;Goonda&#8221; as contemplated under the  Tamil  Nadu  Prevention  of<br \/>\nDangerous   Activities  of  Bootleggers,  Drug  Offenders,  Forest  Offenders,<br \/>\nGoondas, Immoral Traffic Offenders, Slum Grabbers and Video Pirates Act,  1982<br \/>\n(Tamil  Nadu Act 14 of 1982), by the impugned detention order dated 13.2.2006,<br \/>\nchallenges the same in this Petition.\n<\/p>\n<p>        2.  Heard learned counsel  for  the  petitioner  as  well  as  learned<br \/>\nAdditional Public Prosecutor for the respondents.\n<\/p>\n<p>        3.  At the foremost, learned counsel for the petitioner submitted that<br \/>\nthere is enormous delay in disposal of the representation of the detenu, which<br \/>\nvitiates the  ultimate order of detention.  With reference to the above claim,<br \/>\nlearned Additional Public Prosecutor has placed the details, which  show  that<br \/>\nthe  representation  of  the  detenu  dated  2  2.3.2006  was  received by the<br \/>\nGovernment on 23.3.2006 and remarks were called for on 24.3.2006.  Thereafter,<br \/>\nthe remarks were received by the Government on  30.3.2006  and  the  File  was<br \/>\nsubmitted  on 31.3.2006 and the same was dealt with by the Under Secretary and<br \/>\nthe Deputy Secretary on 3.4.2006 and finally, the Minister for Prohibition and<br \/>\nExcise passed orders on 10.4.2006.  The rejection letter was prepared  on  the<br \/>\nsame day  i.e.   on 10.4.2006 and the same was sent to the detenu on 11.4.2006<br \/>\nand served to him on 12.4.2006.  As rightly pointed out by the learned counsel<br \/>\nfor the petitioner, though the file was dealt with by the Deputy Secretary  on<br \/>\n3.4.2006,  Minister for Prohibition and Excise passed the order on 10.04.2006,<br \/>\nthere is no explanation at all for taking  time  for  passing  orders  by  the<br \/>\nMinister for  Prohibition  and  Excise  till 10.4.2006.  In the absence of any<br \/>\nexplanation by the person  concerned  even  after  excluding  the  intervening<br \/>\nholidays,  we  are  of  the view that the time taken for passing orders by the<br \/>\nMinister for Prohibition and Excise is on the higher side and we hold that the<br \/>\nsaid delay has prejudiced the detenu in disposal of his  representation.    On<br \/>\nthis ground, we quash the impugned order of detention.\n<\/p>\n<p>        4.   Accordingly,  the  Habeas  Corpus  Petition  is  allowed  and the<br \/>\nimpugned order of detention is set aside.  The detenu is directed to be set at<br \/>\nliberty forthwith from the custody unless he is required in some other case or<br \/>\ncause.\n<\/p>\n<p>ajr<\/p>\n<p>To<\/p>\n<p>1.
