The Labour Court,<br \/>\n\tafter hearing both the sides, allowed the reference partly by way of<br \/>\n\tthe impugned award. Hence, this petition.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsel for the respective parties and perused the documents<br \/>\n\ton record. The respondent was found guilty of serious irregularity \/<br \/>\n\tmisconduct on Twenty-Eight (28) different occasions in the past. Of<br \/>\n\tthese defaults, many defaults related to incidents of similar<br \/>\n\tnature. In spite of being found guilty of similar defaults in the<br \/>\n\tpast, the respondent did not improve his behaviour and continued to<br \/>\n\tcommit such misconduct, which is highly unbecoming of a public<br \/>\n\tservant.\n<\/p>\n<p>Looking<br \/>\n\tto the facts of the case and the past record of the respondent, I am<br \/>\n\tof the opinion that the Labour Court ought not to have completely<br \/>\n\tset aside the order of dismissal, as it would amount to granting<br \/>\n\tpremium to a wrong-doer. In my opinion, if the penalty of stoppage<br \/>\n\tof Five (5) Increments with future effect is imposed on the<br \/>\n\trespondent, the same would meet with the ends of justice. Orders<br \/>\n\taccordingly. The impugned award stands modified accordingly. The<br \/>\n\torder passed by the Labour Court granting backwages to the<br \/>\n\trespondent is quashed and set aside since the Labour Court has no<br \/>\n\tpowers under Section 11(A) of the Act to grant any backwages. The<br \/>\n\tpetitioner is directed to reinstate the respondent on or before 01st<br \/>\n\tOctober 2010. The respondent be granted the other ensuing benefits<br \/>\n\twithin a period of six months from today. The petition<br \/>\n\tstands disposed of accordingly.
