No.12117 of 2010 there are two<\/p>\n<p>                  petitioners and in C.W.J.C. No.14617 of 2010 there are four<\/p>\n<p>                  petitioners. The two writ petitions are for similar relief, as<\/p>\n<p>                  such, are being taken up together.\n<\/p>\n<p>                                 The writ petitioners are doctors in the Bihar<\/p>\n<p>                  Health Service Cadre.     The State Government has several<\/p>\n<p>                  Medical Colleges. As per M.C.I. regulations, the Medical<\/p>\n<p>                  Colleges have to have a minimum staff as per staffing pattern<\/p>\n<p>                  which includes teaching and non-teaching staff as well. This<\/p>\n<p>                  includes a minimum number of Tutors\/Senior Residents. For<\/p>\n<p>                  several years, if not decade, the requisite number is not<\/p>\n<p>                  available to the State. Therefore, they were recruiting doctors<\/p>\n<p>                  from Bihar Health Service on contractual basis.            The<\/p>\n<p>                  petitioners are doctors who have been recruited on contractual<\/p>\n<p>                  basis to comply with the M.C.I. regulations as Tutors\/Senior<\/p>\n<p>                  Residents and have been posted in different Medical College<\/p>\n<p>                  Hospitals in Bihar. Their contract is renewed from time to<\/p>\n<p>                  time. By now they have completed 2\u00bd years as Tutors\/Senior<\/p>\n<p>                  Residents. In the year 2008, the State Government made its<br \/>\n<span class=\"hidden_text\">                      -2-<\/span><\/p>\n<p>own Rules, which were notified on 30th October, 2008, known<\/p>\n<p>as Senior Residents, Tutor Medical Education Service Cadre<\/p>\n<p>Recruitment and Appointment Rules, 2008.              Now by an<\/p>\n<p>advertisement as issued on about 25th December, 2009 State<\/p>\n<p>wants to make direct recruitment under the said Rules of<\/p>\n<p>Tutors\/Senior Residents for which a panel is to be prepared.<\/p>\n<p>Petitioners apprehend that before their last one year tenure<\/p>\n<p>expires on 31.03.2011, their contractual appointments may be<\/p>\n<p>cancelled, which would adversely affect as that would deprive<\/p>\n<p>them of three years experience as Tutors\/Senior Residents and<\/p>\n<p>other benefits. Their only grievance is to let them continue at<\/p>\n<p>least up to 31.03.2011.\n<\/p>\n<p>               Learned counsel for the State points out that<\/p>\n<p>their appointment itself shows that they would not be given<\/p>\n<p>any experience certificate for this work as Tutors\/Senior<\/p>\n<p>Residents.\n<\/p>\n<p>               Mr. Shivajee Pandey, learned Senior Counsel<\/p>\n<p>appearing for the petitioners states that on opportune time<\/p>\n<p>respondents may consider the challenge, the said provision is<\/p>\n<p>wholly arbitrary and unjustified. Their clients seek limited<\/p>\n<p>relief to continue as Tutors\/Senior Residents.<\/p>\n<p>               Learned counsel for the State then points out<\/p>\n<p>that preparation and finalizing of panel and issuing of<\/p>\n<p>selection letters would itself take some more time.<\/p>\n<p>               Be that as it may, let learned counsel for the<br \/>\n<span class=\"hidden_text\">                                    -3-<\/span><\/p>\n<p>           State seek instructions in the matter and file a comprehensive<\/p>\n<p>           counter affidavit so that the matter may be disposed of at the<\/p>\n<p>           stage of admission itself. They would also be required to<\/p>\n<p>           bring on record the difficulty if any that would be created if<\/p>\n<p>           petitioners are allowed to continue up to 31st March, 2011.<\/p>\n<p>           State may, however, proceed with preparation and finalization<\/p>\n<p>           of the panel but would not displace the petitioners till further<\/p>\n<p>           orders of this Court.\n<\/p>\n<p>                          Put up this case &#8220;For Admission&#8221;
