      Heard Sri.U.Balagangadharan, the learned counsel appearing for the<\/p>\n
petitioner and Sri.P.C.Sasidharan, the learned standing counsel appearing<\/p>\n
for the Calicut University. In the nature of the order that I propose to<\/p>\n
pass, it is not necessary to issue notice to or hear the third respondent.<\/p>\n
      2.     The petitioner appeared for the eighth semester B.Tech.<\/p>\n
degree examination in Electrical and Electronic Engineering conducted by<\/p>\n
the University of Calicut in May 2009 with register No.AMAFEE039. The<\/p>\n
results were published in August 2009. The petitioner failed in the paper<\/p>\n
on Bio Medical Instrumentation (EEE810).         He has passed the other<\/p>\n
semester examinations and the other papers of the 8th semester<\/p>\n
examination.     He has therefore applied for revaluation of his answer<\/p>\n
script in Bio Medical Instrumentation (EEE810) on 20.8.2009 in the<\/p>\n
prescribed form and has also paid the requisite fee. The petitioner states<\/p>\n
that since he did not retain a copy of the application and the receipt<\/p>\n
evidencing payment of fee, he is not a in a position to produce the same.<\/p>\n
He submits that if his answer script in Bio Medical Instrumentation<\/p>\n
(EEE810) is revalued he is sure to secure a pass and that unless his<\/p>\n
answer script is expeditiously revalued he will not be in a position to<\/p>\n
W.P(C) No.26315 of 2009-H              2<\/span><\/p>\n
pursue his studies in the current academic year. He submits that seeking<\/p>\n
expeditious    revaluation   of   his   answer    script   in  Bio  Medical<\/p>\n
Instrumentation (EEE810) he had submitted Ext.P2 representation dated<\/p>\n
20.8.2009 to the Controller of Examinations, University of Calicut. In this<\/p>\n
writ petition, the petitioner seeks a writ in the nature of mandamus<\/p>\n
commanding the second respondent to re-value his answer script in Bio<\/p>\n
Medical Instrumentation (EEE810) for which he appeared in the 8th<\/p>\n
semester B.Tech degree examination and to publish the result<\/p>\n
expeditiously and in any event within three weeks.<\/p>\n
       3.    Sri.P.C.Sasidharan, the learned Standing Counsel appearing<\/p>\n
for the Calicut University submits that the petitioner has not furnished<\/p>\n
the details regarding the application for revaluation and payment of fee<\/p>\n
in this writ petition and that as a large number of applications are<\/p>\n
received, the University can only submit that if the petitioner has applied<\/p>\n
for revaluation, the University will take steps to revalue his answer scripts<\/p>\n
and communicate the results within eight weeks. Since the petitioner has<\/p>\n
not, as rightly pointed out by the learned standing counsel for the<\/p>\n
University furnished the details regarding the application for revaluation,<\/p>\n
I dispose of this writ petition with a direction to respondents 1 and 2 to<\/p>\n
revalue the petitioner’s answer script in Bio Medical Instrumentation<\/p>\n
(EEE810) for which he appeared in the 8th semester examination in<\/p>\n
W.P(C) No.26315 of 2009-H            3<\/span><\/p>\n
Electrical and Electronic Engineering held by the University of Calicut with<\/p>\n
register No.AMAFEE039, if his application has been received and is in<\/p>\n
order and to publish the result within eight weeks from today.<\/p>\n
