Kodekar, waives service of notice of rule on<br \/>\n\tbehalf of State.\n<\/p>\n<p>By<br \/>\n\tthis application under Section 438 of the Code of Criminal<br \/>\n\tProcedure, the accused-applicant has prayed for anticipatory bail in<br \/>\n\tconnection with CR No. I-27 of 2011 registered with  Vadodara Taluka<br \/>\n\tPolice  Station for the  offences punishable under Sections   465,<br \/>\n\t467, 468, 471 and 114 of Indian Penal Code.\n<\/p>\n<p>I<br \/>\n\thave heard learned Sr. Advocate, Mr. P.M. Thakkar for the<br \/>\n\taccused-applicant and learned APP, Mr. R.C. Kodekar for the<br \/>\n\trespondent-State.\n<\/p>\n<p>Having<br \/>\n\tregard to the rival contentions of the respective counsel and having<br \/>\n\tconsidered the case of the prosecution and the allegations against<br \/>\n\tthe accused-applicant and as the parties have not pressed for<br \/>\n\treasoned order, I am inclined to exercise my discretion in favour of<br \/>\n\tthe accused-applicant considering the following aspects:\n<\/p>\n<p>[a]\tApplicant-accused<br \/>\n\tis a lady aged about 62 years.\n<\/p>\n<p>[b]\tAll<br \/>\n\toffences are Magistrate triable.\n<\/p>\n<p>[c]\tNo<br \/>\n\tpast history of criminal antecedents. FIR is filed after eight<br \/>\n\tyears.\n<\/p>\n<p>[d]\tEntire<br \/>\n\tdispute is of civil nature and civil suits are pending and no<br \/>\n\tallegations of forging any documents are made.\n<\/p>\n<p>In<br \/>\n\tthis view of the matter, accused-applicant is ordered to be enlarged<br \/>\n\ton anticipatory bail in the event of her arrest in connection with<br \/>\n\tCR No. I-27\/2011 registered with Vadodara Taluka Police Station. She<br \/>\n\tshall be released on bail on furnishing a bond of Rs.15,000\/-(Rupees<br \/>\n\tFifteen Thousand Only) with one surety of like amount on following<br \/>\n\tconditions that she:\n<\/p>\n<p>(A)\tshall<br \/>\ncooperate with the investigation and make herself available for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>(B)\tshall<br \/>\nremain present before the IO at the concerned police station on 19th<br \/>\nMay, 2011 between 9.00 a.m. to 2.00 p.m. <\/p>\n<p>(C)\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>(D)\tshall<br \/>\nat the time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>(E)\twill<br \/>\nnot leave India without the permission of the Court and if is holding<br \/>\na passport, shall surrender the same before the trial Court within a<br \/>\nweek;\n<\/p>\n<p>(F)\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>It<br \/>\n\twould be open for the Investigating Agency to apply to the competent<br \/>\n\tMagistrate, for police remand of the applicant. The applicant shall<br \/>\n\tremain present before the learned Magistrate on the first date of<br \/>\n\thearing on such application and on all subsequent occasion, as may<br \/>\n\tbe directed by the learned Magistrate. This would be sufficient to<br \/>\n\ttreat the accused in the judicial custody for the purpose of<br \/>\n\tentertaining application of the prosecution for police remand. This<br \/>\n\tis, however, without prejudice to the right of the accused to seek<br \/>\n\tstay against an order of remand, if ultimately granted, and the<br \/>\n\tpower of the learned Magistrate to consider such a request in<br \/>\n\taccordance with law. It is clarified that the applicant, even if is<br \/>\n\tremanded to the police custody upon completion of such period of<br \/>\n\tpolice remand, shall be set free immediately, subject to other<br \/>\n\tconditions of this anticipatory bail order.\n<\/p>\n<p>With<br \/>\n\tthese directions, application is allowed.
