Thanu, Sr. Manager<\/p>\n<p>                       Ms. Sunita Dahat-Appellant<\/p>\n<p>                                          DECISION<\/p>\n<p>      All four appeals filed by the appellant against M\/s MMTC Limited concern<br \/>\nwith same opposite parties and issues connected with each other and hence were<br \/>\ntaken up together for hearing on 7.7.2008. The hearing was attended by the<br \/>\nappellant in person. The respondent was represented by the following officials:\n<\/p>\n<blockquote><p>      Mr. Rajeev Jaideva, CGM<br \/>\n      Mr. Ashok Sharma, CGM (Law)<br \/>\n      Mr. Vijay Pal, CGM<br \/>\n      Mr. B.P. Jain, GM<br \/>\n      Mr. R. Thanu, Sr. Manager<\/p>\n<p>I have gone through the RTI application as well as replies received in this<br \/>\nconnection. It is seen that the replies have gone in all the four appeals. However,<br \/>\nhaving not completely satisfied with the replies the appellant has preferred these<br \/>\n<span class=\"hidden_text\">                                                1<\/span><br \/>\n four appeals before the Commission. After going through all the records and after<br \/>\nhearing the parties in a lengthy deliberation, the following directions are issued<br \/>\nwherever necessary in the following manner:\n<\/p><\/blockquote>\n<blockquote><p>      File No. 296: In this appeal the appellant has asked for attested copies of<br \/>\nvarious documents relating to the functioning of MMTC including copies of audit<br \/>\nreports, agenda and minutes of the meeting for various years. As far as the query<br \/>\nno.1 &amp; 2 is concerned, though the CPIO has denied the information under section<br \/>\n8(1)(d), he has been directed to consider the request once more if the appellant<br \/>\ncould be specific in his query.       Accordingly, during the hearing itself, the<br \/>\nappellant has chosen the information for the year 2005-06 and it was agreed by the<br \/>\nrespondent that the information will be provided after segregating the information<br \/>\nwhich comes under the exempt category. As far as the query no.4, though it is<br \/>\npurely a third party information, it has been directed that statistical no. regarding<br \/>\nCBI cases be provided to the appellant. Regarding other queries, no intervention of<br \/>\nthe Commission is warranted.<\/p><\/blockquote>\n<p>       File No. 339: In this appeal query nos. 7 &amp; 8 have been transferred to<br \/>\nMMTC by the Commerce Ministry. Though the CPIO has given reply in respect<br \/>\nof query regarding Mr. Sanjiv Batra he has denied the information regarding<br \/>\nminutes under section (1)(d) of the RTI Act. Here the CPIO has been directed to<br \/>\ncheck up once again in case if the appellant asks for any specific information about<br \/>\nthe Board meeting. As regards the query no.8 the appellant denied the statement of<br \/>\nthe respondents that the information is already been available in the website. The<br \/>\nCPIO is directed to check up this and update the website information also.\n<\/p>\n<p>       File No. 340: In this appeal though the appellant has been given replies in<br \/>\nrespect of all the queries the appellant was not satisfied with the reply given under<br \/>\nquery nos. 5 &amp; 6. However, during the hearing, the issue has further been<br \/>\nclarified.\n<\/p>\n<p>       File No. 709: Here a general issue was raised that the appellant has filed her<br \/>\nfirst appeal at Mumbai office, whereas she should have preferred the same in the<br \/>\nDelhi Office. However, the Commission felt that though the appeal is presented at<br \/>\nMumbai, it should have been forwarded to HQ and it has been directed that they<br \/>\nshould issue proper instructions to their subordinate offices in this connection.<br \/>\nHere the appellant has made specific request on query nos. 3, 4, 5, 6 &amp; 10 only. As<br \/>\nfar as query nos. 3, 4 &amp; 5, the CPIO has been directed to give only the information<br \/>\nregarding creation of posts, agenda notes and resolution need to be given and no<br \/>\nother information need be given. As far as query no.6 regarding Senior<br \/>\nDepartmental Promotion Committee, the CPIO has been directed to give the<br \/>\nparticulars regarding date of the meeting, members of the Board, candidates who<br \/>\n<span class=\"hidden_text\">                                         2<\/span><br \/>\n were considered for selection and candidates who were selected and marks<br \/>\nobtained by the selected candidates etc. In the case of non-selected candidates,<br \/>\nappellant&#8217;s own marks can be given.
