JUSTICE AJAI LAMBA\n\n\nPRESENT: -          Mr. Sameer Sachdeva, Advocate, for\n                    the petitioner.\n\n\n                                .      .      .\n\nAJAI LAMBA, J (Oral)\n\n                    The   prayer           made   in   this     civil   writ\n\npetition     filed        under       Article          226\/227     of     the\n\n<\/pre>\n<p>Constitution of India is for issuance of a writ in<\/p>\n<p>the nature of mandamus directing the respondents to<\/p>\n<p>comply with the directions given by Division Bench<\/p>\n<p>of this Court while dealing with Civil Writ Petition No.14340<\/p>\n<p>of 2006 titled &#8216;Arya College, Ludhiana Vs. State of Punjab &amp; Others&#8217;,<\/p>\n<p>decided on 18.12.2007.\n<\/p>\n<pre>                    It    has       been     brought      out    that     the\n\npetitioner     is    helping         the     State      to    achieve     its\n\n<\/pre>\n<p>welfare policies. The State of Punjab implemented a<\/p>\n<p>scheme known as `95% Deficit Grant in Aid Scheme&#8217;<\/p>\n<p>for granting financial assistance to non government<\/p>\n<p>aided    colleges.        The        State        Government       took    a<br \/>\n CWP No.7995 of 2009                                                [2]<\/p>\n<p>conscious decision to provide financial assistance<\/p>\n<p>to private aided colleges to enable these colleges<\/p>\n<p>to pay the scales recommended by the UGC so as to<\/p>\n<p>maintain minimum standards in higher                              education on<\/p>\n<p>the basis of sanctioned strength of teaching and non<\/p>\n<p>teaching employees. Because the respondents are not<\/p>\n<p>releasing      the          admissible           grant        in         aid,     the<\/p>\n<p>petitioner is unable to pay the teaching and non<\/p>\n<p>teaching staff which seriously hampers the working<\/p>\n<p>of the Institution.\n<\/p>\n<p>                      Issue notice of motion.\n<\/p>\n<pre>                      Mr.       Anil        Sharma,          Senior          Deputy\n\nAdvocate     General,          Punjab,        on     the     asking        of     the\n\n<\/pre>\n<p>Court, accepts notice. Copy of the petition has been<\/p>\n<p>handed over.\n<\/p>\n<p>                      Heard.\n<\/p>\n<p>                      Learned        counsel        for     the      respondents<\/p>\n<p>has not been able to dispute that grant in aid is<\/p>\n<p>required to be released in terms of the judgment<\/p>\n<p>relied upon on behalf of the petitioner.<\/p>\n<p>                      I     have      considered           the       issue.       The<\/p>\n<p>Division Bench in the case of Arya College, Ludhiana (supra),<\/p>\n<p>issued directions in the following terms:-<\/p>\n<blockquote><p>                             &#8220;Accordingly, we direct the State to meet its liability<br \/>\n                      as per its declared scheme within three months from today.<br \/>\n                      The State will be at liberty to rely upon the record already<br \/>\n                      available or to have access to such other record of the<br \/>\n                      petitioner-college as, may be necessary, but on this<br \/>\n                      account, the State will not avoid its liability. We make it<br \/>\n                      clear that Secretary, Higher Education, Punjab will be held<br \/>\n                      personally liable in case of default in meeting the<br \/>\n                      liability.&#8221;<\/p><\/blockquote>\n<pre>\n\n                      This     Court       has     considered            the    very\n CWP No.7995 of 2009                                     [3]\n\n\n\n<\/pre>\n<blockquote><p>issue while dealing with Civil Writ Petition No.4464 of 2009<\/p>\n<p>titled &#8216;<a href=\"\/doc\/434381\/\">BLM Girls College, Arya Samaj, Nawanshahr vs. State of Punjab<\/p>\n<p>&amp; Others&#8217;,<\/a> decided on 21.3.2009 and Civil Writ Petition No.5393<\/p>\n<p>of 2008, titled &#8216;Ramgaria College of Education, Phagwara vs. State of<\/p>\n<p>Punjab &amp; Others&#8217;, decided on 24.4.2008, in which also<\/p>\n<p>the respondent-State has been directed to release<\/p>\n<p>the grant in aid.<\/p><\/blockquote>\n<p>                      In Civil Writ Petition No.3191 of 2007        titled<\/p>\n<p>`The Managing Committee, Guru Gobind Singh College, Saghera, Barnala,<\/p>\n<p>District Sangrur vs. State of Punjab &amp; Another&#8217;           decided        on<\/p>\n<p>19.2.2008, similar view has been taken and direction<\/p>\n<p>was issued to the respondents to release grant in<\/p>\n<p>aid. Special Leave Petition was filed by the State<\/p>\n<p>of Punjab, the same being SLP No.15798 of 2008 which was<\/p>\n<p>dismissed on 8.12.2008.\n<\/p>\n<p>                      Considering the directions issued by<\/p>\n<p>this Court in various cases as noticed above, and in<\/p>\n<p>the    facts   and      circumstances     of   this     case,       it   is<\/p>\n<p>directed that the respondents shall pay 85% of the<\/p>\n<p>grant-in-aid due to the petitioner within a period<\/p>\n<p>of 4 months after clearance of objections by the<\/p>\n<p>petitioner.
