Notice has<br \/>\n\tbeen served to respondent no. 1, but no appearance is filed by<br \/>\n\trespondent no. 1.\n<\/p>\n<p>The<br \/>\n\tappellant original claimant filed present appeal for enhancement of<br \/>\n\taward passed by claims Tribunal.  The claims Tribunal has awarded<br \/>\n\tRs. 3,89,000\/- being a compensation with 7.5% interest on 11\/7\/2007.<br \/>\n\tThe appellant has made claim of Rs. 9,00,000\/- for a compensation.\n<\/p>\n<p>The<br \/>\n\tfact of present case is that accident took place on 26\/12\/1996 while<br \/>\n\the was driving his scooter met with an accident with bus owned by<br \/>\n\trespondent no. 2.  At the relevant time, claimant was aged about 36<br \/>\n\tyears and on account of injury sustained by appellant due to<br \/>\n\taccident he was removed to Anad Orthopedic hospital for treatment at<br \/>\n\tNadiad.  Due to said accident, he has sustained permanent disability<br \/>\n\tas he remained in bed and was not able to do his daily work.\n<\/p>\n<p>Therefore,<br \/>\n\tlearned advocate Mr. Savani submitted that claims Tribunal has<br \/>\n\tcommitted gross error in assessing compensation in favour of<br \/>\n\tclaimant. He submitted that compensation which is awarded by claims<br \/>\n\tTribunal is in lower side.  The claims tribunal has committed error<br \/>\n\tin assessing 36% permanent disability when in medical certificate it<br \/>\n\twas certified 49% by Doctor Mr. Shah, which also supported by<br \/>\n\tmedical certificate produced before claims Tribunal.\n<\/p>\n<p>He<br \/>\n\tsubmitted that total period of remaining without work was more than<br \/>\n\tone year, even though that much amount is not given by tribunal for<br \/>\n\tloss of actual income. Therefore, according to him claims Tribunal<br \/>\n\thas committed error.  The present appeal is filed for enhancement of<br \/>\n\tawarded compensation.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Ms. Pandey appearing for respondent submitted that claims<br \/>\n\tTribunal has rightly examined matter on each and every aspects and<br \/>\n\tproperly appreciated evidence. The claims Tribunal has awarded<br \/>\n\treasonable compensation, which can not consider to be in lower side<br \/>\n\tin any manner. Therefore, according to her submission no<br \/>\n\tinterference is required by this Court.\n<\/p>\n<p>I<br \/>\n\thave considered submissions made by both learned advocates and I<br \/>\n\thave perused award passed by claims Tribunal.  The accident occurred<br \/>\n\ton 26\/12\/1996 and claimant has received 49% disability as per<br \/>\n\tmedical certificate produced by Dr. Jatin Shah vide exh 40\/41. The<br \/>\n\tclaims Tribunal has considered income part of claimant as per<br \/>\n\tevidence of claimant exh 1, his monthly income was Rs. 14,000\/- per<br \/>\n\tmonth, same fact has been stated by him in his affidavit, total<br \/>\n\tcomes to Rs. 1,68,000\/- per year. The tribunal has considered income<br \/>\n\tfor the year 1996, when accident occurred and decided monthly income<br \/>\n\tof Rs. 6000\/- and yearly income of Rs. 72,000\/- which was received<br \/>\n\tby him in 1996. The evidence of claimant mentioning income for<br \/>\n\tpresent period and he was not receiving Rs. 14,000\/- salary in the<br \/>\n\tyear 1996.  Therefore, claims Tribunal has reduced it and reasonably<br \/>\n\tfixed amount of Rs. 6,000\/- per month.  The tribunal has considered<br \/>\n\tactual loss cause to claimant and come to conclusion that about six<br \/>\n\tmonth, he remained out of job, therefore, Rs. 36000\/- has been<br \/>\n\tawarded.\n<\/p>\n<p>The<br \/>\n\tclaims Tribunal has considered various decision on said subject and<br \/>\n\trelied upon evidence of Dr. Shah, in which he made it clear in cross<br \/>\n\texamination that claimant&#8217;s right and left leg injured due to said<br \/>\n\taccident and 36% disability may be taken into account.  On that<br \/>\n\tbasis discussion is made in para 60, 61 and 66 which are quoted as<br \/>\n\tunder:\n<\/p>\n<p>?S60.\tIn<br \/>\n\t\tcross examination he has stated that the right and left leg<br \/>\n\t\tdisability of the applicant comes to 36%.\n<\/p>\n<p>61.\tOn<br \/>\n\t\tperusal of disability certificate issued by the doctor it reveals<br \/>\n\t\tthat the applicant has sustained 49% disability of his right leg<br \/>\n\t\tand left leg which comes to 36% as per cross examination of the<br \/>\n\t\tapplicant. Hence after accident the applicant has sustained<br \/>\n\t\tpermanent disability of 36%.\n<\/p>\n<p>66.\tThe<br \/>\n\t\tapplicant has stated that his age as 36 years in the application<br \/>\n\t\texh 1 and in exh 21 the injury certificate the doctor Mr. J.B.Shah<br \/>\n\t\thas stated that age of applicant as 35 years.  Therefore, this<br \/>\n\t\ttribunal decide that at the time of accident the applicant was aged<br \/>\n\t\t35 years.  Hence 16 multiplier can be pressed into service while<br \/>\n\t\tmultiplying Rs. 1,08,000\/- by 16 comes to Rs. 17,28,000\/- x 36%<br \/>\n\t\tsustained by applicant it comes to Rs. 6,22,000\/-.  Hence this<br \/>\n\t\tTribunal award Rs. 6,22,000\/- to the applicant for future loss of<br \/>\n\t\tincome.  Hence total figure comes to Rs. 7,78,000\/-.  But the<br \/>\n\t\tapplicant is not entitled to recover this amount as compensation<br \/>\n\t\tfrom the opponents. As discussed above this amount shall have to be<br \/>\n\t\tslice down to one half which comes to Rs. 3,89,000\/- as<br \/>\n\t\tcompensation jointly and severally from the opponent no. 1 and 2.??\n<\/p>\n<p>The<br \/>\n\tclaims Tribunal has passed very detailed award running about 34<br \/>\n\tpages and considering number of decisions delivered by High Court as<br \/>\n\twell as Apex Court and properly appreciated evidence on record.<br \/>\n\tTherefore, according to my opinion, the compensation which is<br \/>\n\tawarded by claims Tribunal can not consider to be in lower side in<br \/>\n\tany manner, on the contrary it is reasonable, proper and just<br \/>\n\tcompensation. Therefore, contention raised by learned advocate Mr.<br \/>\n\tSavni can not be accepted and same is rejected.\n<\/p>\n<p>The<br \/>\n\tclaims Tribunal has not committed any error which would require<br \/>\n\tinterference by this Court.  Hence there is no substance in the<br \/>\n\tpresent appeal.
