APP (SJ) No.901 of 2010\n                        RAM PRAVESH PASWAN\n                                  Versus\n                          THE STATE OF BIHAR\n                                 -----------\n<\/pre>\n<p>02.   14.09.2010            This appeal will be heard.<\/p>\n<p>                            Call for the L.C.R<\/p>\n<p>                            As to the prayer for bail, learned counsel for<\/p>\n<p>                   the appellant submits that the appellant along with<\/p>\n<p>                   others was convicted under Section 304 Part-II of the<\/p>\n<p>                   I.P.C.   It is submitted that the occurrence is said to<\/p>\n<p>                   have taken place due to dispute regarding taking of<\/p>\n<p>                   water from hand pipe and the allegation was that the<\/p>\n<p>                   appellant and others assaulted the deceased with lathi<\/p>\n<p>                   but without any specific attribution as to who had<\/p>\n<p>                   caused the fatal blow causing to death.       Learned<\/p>\n<p>                   counsel also submits that appellant was on bail<\/p>\n<p>                   during trial. Further submission is that other accused<\/p>\n<p>                   who have filed separate Cr. Appeal No.773 of 2010<\/p>\n<p>                   and whose case is similarly situated have already<\/p>\n<p>                   been allowed bail by this Court.\n<\/p>\n<p>                            In the facts and circumstances, during the<\/p>\n<p>                   pendency of the appeal, appellant Ram Pravesh<\/p>\n<p>                   Paswan is admitted to bail on furnishing bail bond of<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>       Rs.10,000\/- (Ten thousand) with two sureties of the<\/p>\n<p>       like amount each to the satisfaction of Addl. Sessions<\/p>\n<p>       Judge, F.T.C. No.II, Jehanabad in connection with<\/p>\n<p>       Sessions Trial No.256 of 2001\/107 of 2010.<\/p>\n<p>                 The realization of fine imposed on the<\/p>\n<p>       appellant will remain stayed till the disposal of<\/p>\n<p>       appeal.\n<\/p>\n<\/p>\n<p>                                  (C.M.
