ANANDI SINGH, SON OF KRISHNANDAN SINGH, RESIDENT OF VILLAGE\n       ASMA, POLICE STATION PAKARIWARAWA, DISTRICT NAWADA\n                                *********\n<\/pre>\n<p>2      28\/06\/2011            Heard Counsel for the petitioner and the A.P.P.<\/p>\n<p>                    appearing on behalf of the State.\n<\/p>\n<p>                              The petitioners are aggrieved by the order<\/p>\n<p>                    dated 02.05.2008 passed in Criminal Revision No. 21 of<\/p>\n<p>                    2008 by which the Sessions Judge, Nawada has affirmed<\/p>\n<p>                    the order dated 28.03.2008 passed in Complaint Case<\/p>\n<p>                    No. 14 of 2006 by which the Sub Divisional Judicial<\/p>\n<p>                    Magistrate, Nawada has taken cognizance for the offences<\/p>\n<p>                    alleged to have been committed under Sections 498A and<\/p>\n<p>                    304B of the Indian Penal Code.\n<\/p>\n<p>                             The background of the case is that a First<\/p>\n<p>                    Information Report was instituted. On investigation, it<\/p>\n<p>                    was found that the case under Section 304B of the Indian<\/p>\n<p>                    Penal Code was not true. The Chief Judicial Magistrate<\/p>\n<p>                    accepted the final form but subsequently, cognizance was<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        taken on the basis of the protest petition.<\/p>\n<p>                     Learned Counsel for the petitioners submits<\/p>\n<p>        that the case is completely untrue. The deceased lady<\/p>\n<p>        was married as far back as in the year 1987 with<\/p>\n<p>        petitioner no. 1 and they have been living as husband<\/p>\n<p>        and wife without any problem. The present case has been<\/p>\n<p>        filed just to harass the husband and other family<\/p>\n<p>        members who are well placed in life and to extract money<\/p>\n<p>        out of them. Learned Counsel further submits that<\/p>\n<p>        Annexure-2 series and the voters list is sufficient to<\/p>\n<p>        indicate that the marriage takes place in the year 1987<\/p>\n<p>        and as such, it does not fall within the purview of Section<\/p>\n<p>        304B of the Indian Penal Code. It is also submitted that<\/p>\n<p>        the allegation under Section 498A of the Indian Penal<\/p>\n<p>        Code are very misplaced as the marriage is about 16<\/p>\n<p>        years old.\n<\/p>\n<p>                     All these aspects of the matter cannot be<\/p>\n<p>        considered by this Court at this stage.<\/p>\n<p>                     The petitioners would be at liberty to raise all<\/p>\n<p>        these points at the appropriate stage of the case.<\/p>\n<p>                     This application is accordingly dismissed.<\/p>\n<pre>Anand                                          ( Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sanjay Singh &amp; Ors vs State Of Bihar &amp; Anr on 28 June, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.MISC.
