Justice V.GIRI\n\n Dated :22\/02\/2008\n\n O R D E R\n                                     V.GIRI,J.\n\n                             -------------------------\n\n                        W.P ( C) No. 2734 of 2008\n\n                             --------------------------\n\n                  Dated this the 22nd   February, 2008\n\n\n                               J U D G M E N T\n<\/pre>\n<p>       The   1st  petitioner   availed   a   loan   from   the   3rd  respondent<\/p>\n<p>Bank   for   purchase   of   a   Stage   Carriage   Bus.     Apparently,   the<\/p>\n<p>vehicle was thereafter sold to the  4th respondent  under Exhibit<\/p>\n<p>P1 agreement.  It seems that there was default in the repayment<\/p>\n<p>of  loan  and   there  are   rival  versions   as  to   whether     default   was<\/p>\n<p>committed by the petitioners or by the 4th respondent or by both<\/p>\n<p>of   them.       It   is   not   necessary   to     resolve   that   dispute   in   the<\/p>\n<p>present   case.     Petitioners   are   aggrieved   by   the   proceedings<\/p>\n<p>under   the   Revenue  Recovery   Act,  as  evidenced   by   Exhibits     P3<\/p>\n<p>and   P6.         It   is   inter   alia   contended   by   the   petitioners   that<\/p>\n<p>normally   the   provisions   of   the   Revenue   Recovery   Act   are   not<\/p>\n<p>accessible   to   a   Private   Bank   like   the   3rd  respondent     and<\/p>\n<p>therefore notices under the   Revenue Recovery Act   are without<\/p>\n<p>jurisdiction.\n<\/p>\n<p>       2.     I   heard   the   learned   counsel   for   the   petitioners<\/p>\n<p>Mr.P.K.Suresh   Kumar,   the   learned   standing   counsel   for   the   3rd<\/p>\n<p>W.P ( C) No. 2734 of 2008<\/p>\n<p><span class=\"hidden_text\">                                         2<\/span><\/p>\n<p>respondent Mr.R.S.Kalkura and the learned Government Pleader<\/p>\n<p>as   also   the   learned            counsel   for   the   4th        respondent<\/p>\n<p>Sri.Narayanan.     Mr.R.S.Kalkura,   learned   standing   counsel   for<\/p>\n<p>the   3rd  respondent submits that the vehicle loan is   liable to be<\/p>\n<p>treated   as   one   in   the   priority   list   going   by   the   RBI   Circular<\/p>\n<p>issued   in   that   behalf.       Learned   counsel   for   the   petitioners<\/p>\n<p>submits that  even if it is so, they may not be comprehended  by<\/p>\n<p>the   notification   under   the   Revenue   Recovery   Act,   which   is<\/p>\n<p>invoked   by   Private   Commercial   Bank   for   initiating   proceedings<\/p>\n<p>under the Revenue Recovery Act.  This is an area on which there<\/p>\n<p>is   dispute   and   in   my   view,   since   what   is   challenged   is   the<\/p>\n<p>jurisdiction   of     the   competent   authority   under   the   Revenue<\/p>\n<p>Recovery   Act,   it   is   only   appropriate   that   the   said     dispute     be<\/p>\n<p>resolved by an officer at the level of the District Collector, in the<\/p>\n<p>first instance.\n<\/p>\n<p>      In the result, the writ petition is disposed of in the following<\/p>\n<p>terms:\n<\/p>\n<p>      i)     Petitioner     may   raise   these   objections     producing<\/p>\n<p>therewith a copy of notification under the Revenue Recovery Act<\/p>\n<p>by   way   of     representation     before   the   District   Collector,   within<\/p>\n<p>W.P ( C) No. 2734 of 2008<\/p>\n<p><span class=\"hidden_text\">                                         3<\/span><\/p>\n<p>three weeks  from today.\n<\/p>\n<p>      ii)    Thereupon,   the   District   Collector     &#8211;   2nd  respondent<\/p>\n<p>shall   issue   notice   to   respondents   3   and   4   to   consider   the<\/p>\n<p>question  as to whether  the  loan  availed  by by the  1st  petitioner<\/p>\n<p>is comprehended by the relevant notification under the Revenue<\/p>\n<p>Recovery   Act.     He   shall   pass   reasoned   orders   on   this   aspect.\n<\/p>\n<p>This shall be done after hearing the petitioners and respondents<\/p>\n<p>3 and 4, within two months from the date of receipt of a copy of<\/p>\n<p>the   representation   by   the   petitioner.
