No.827 of 2011\n                                  ABHIMANYU SINGH\n                                           Versus\n                                THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>02   11.02.2011               Both the above stated criminal miscellaneous<\/p>\n<p>                   cases arise out of Bakhtiarpur P.S. Case No. 171 of 2010<\/p>\n<p>                   registered under Sections 302\/34, 447, 323, 324, 307, 504 of<\/p>\n<p>                   the Indian Penal Code and 27 of the Arms Act and<\/p>\n<p>                   accordingly, both the above stated petitions are being disposed<\/p>\n<p>                   of by this common order.\n<\/p>\n<p>                                There is specific allegation against the petitioner<\/p>\n<p>                   in Cr. Misc. No. 827 of 2011 that he gave one axe blow to the<\/p>\n<p>                   informant&#8217;s father, as a result, of which informant&#8217;s father<\/p>\n<p>                   sustained head injury and died in course of his treatment. So<\/p>\n<p>                   far as petitioner in Cr. Misc. No. 819 of 2011 is concerned,<\/p>\n<p>                   allegedly, he assaulted the informant&#8217;s brother with iron rod,<\/p>\n<p>                   as a result, of which informant&#8217;s brother sustained injury on<\/p>\n<p>                   his head.\n<\/p>\n<p>                                Learned counsel for the petitioners drew my<\/p>\n<p>                   attention towards the impugned order of learned Additional<\/p>\n<p>                   Sessions Judge and submitted that the injury report of<\/p>\n<p>                   informant&#8217;s brother has not been collected by the Investigating<\/p>\n<p>                   Officer though he has already submitted charge sheet and<\/p>\n<p>                   therefore, it would be presumed that the informant&#8217;s brother<br \/>\n           has received simple injury. He further submitted that so far as<\/p>\n<p>          petitioner in Cr. Misc. No. 827 of 2011 is concerned,<\/p>\n<p>          allegedly, he had given only one blow to the deceased and the<\/p>\n<p>          post mortem report of the deceased reveals that lacerated<\/p>\n<p>          wound was found on the dead body of the deceased. So in the<\/p>\n<p>          aforesaid circumstance only Section 304 of the Indian Penal<\/p>\n<p>          Code is attracted against the petitioner in Cr. Misc. No. 827 of<\/p>\n<p>          2011.\n<\/p>\n<p>                        Considering      the    aforesaid     facts    and<\/p>\n<p>          circumstances as well as submissions of the parties petitioner<\/p>\n<p>          in Cr. Misc. No. 819 of 2011, namely, Abinash Singh is<\/p>\n<p>          directed to be released on bail on furnishing bail bonds of Rs.<\/p>\n<p>          10,000\/- (Ten Thousand) with two sureties of the like amount<\/p>\n<p>          each to the satisfaction of Chief Judicial Magistrate, Saharsa in<\/p>\n<p>          connection with above stated Bakhtiarpur P.S. Case No. 171 of<\/p>\n<p>          2010.\n<\/p>\n<p>                        So far as the prayer for bail of petitioner in Cr.<\/p>\n<p>          Misc.
