JANUARY 18, 2007\n\n\n                                   ORDER\n<\/pre>\n<p>      The   common   petitioner   in   these   bail   applications     is<\/p>\n<p>the   3rd  accused   in   Crime   No.727\/2006,   the   7th  accused   in<\/p>\n<p>Crime   No.839\/2006   and   the   4th  accused   in   Crime   No.710\/2006<\/p>\n<p>respectively   of   Vaikom   Police   Station   registered   for   an<\/p>\n<p>offence   punishable   under   secs.420   and   certain   other<\/p>\n<p>sections   of   the   I.P.C.     The   petitioner   is   the   wife   of   one<\/p>\n<p>Vinayakumar   who,   along   with   his   brothers,   are   alleged   to<\/p>\n<p>have   taken   deposits   from   the   public   and   swindled   large<\/p>\n<p>amounts of money totalling to more than Rs.2 crores.\n<\/p>\n<p>      2.        The   learned   Public   Prosecutor   opposed   the<\/p>\n<p>application   submitting   inter   alia   that   the   petitioner&#8217;s<\/p>\n<p>husband   who   was   granted   anticipatory   bail   as   per   order   dt.\n<\/p>\n<p>31.8.2006   in   B.A.No.4058\/2006   did   not   comply   with   the<\/p>\n<p>directions issued by this court.\n<\/p>\n<p>      3     Even   though   the   learned   counsel   for   the   petitioner<\/p>\n<p>would   controvert   the   above   submission   of   the   Public<\/p>\n<p>Prosecutor, having regard to the facts and circumstances, I<\/p>\n<p>am   not   inclined   to   grant   anticipatory   bail.     But,   at   the<\/p>\n<p>same   time,   I   am   inclined   to   give   an   opportunity   to   the<\/p>\n<p>petitioner   to   be   subjected   to   custodial   interrogation   as<\/p>\n<p><span class=\"hidden_text\">BA.243,244&amp;245\/2007                   2<\/span><\/p>\n<p>and   when   a   notice   to   that   effect   is   given   by   the<\/p>\n<p>Investigating   Officer   and   then   to   have   her   application   for<\/p>\n<p>regular   bail   considered   by   the   magistrate   concerned.\n<\/p>\n<p>Accordingly, the petitioner shall be liable to be subjected<\/p>\n<p>to custodial interrogation by the investigating officer for<\/p>\n<p>the purpose of recovery of incriminating materials, if any.\n<\/p>\n<p>Due   notice   in   that   behalf   be   given   to   the   petitioner.\n<\/p>\n<p>After   the   interrogation   as   aforesaid,   the   petitioner   shall<\/p>\n<p>either be produced or allowed to file an application before<\/p>\n<p>the   magistrate   concerned   for   regular   bail.     As   and   when<\/p>\n<p>such   an   application   is   filed,   the   same   shall   be   considered<\/p>\n<p>and   disposed   of   preferably   on   the   same   day   on   which   such<\/p>\n<p>application is made.
