The<br \/>\n\tpetitioner together with the other persons submitted the<br \/>\n\tapplication.  The District Collector, Surat, ultimately had passed<br \/>\n\tthe order dated 15.05.2005, whereby the authorisation was granted to<br \/>\n\tthe petitioner.  It appears that thereafter, pursuant to the order<br \/>\n\tpassed by the Collector on 25.07.2005, the Mamlatdar passed the<br \/>\n\torder issuing authorisation and other consequential orders.  The<br \/>\n\trespondent No.3 being aggrieved by the decision of the Collector,<br \/>\n\tpreferred Appeal No.72\/07 before the State Government. Thereafter,<br \/>\n\tthe State Government heard the matter and passed the order on<br \/>\n\t06.02.2008, whereby the appeal is allowed and the order for grant of<br \/>\n\tauthorisation in favour of the petitioner by the District Collector<br \/>\n\tis set aside and it is also ordered that the appellant be granted<br \/>\n\tauthorisation.  It is under these circumstances, the petitioner has<br \/>\n\tapproached to this Court by way of the present petition.\n<\/p>\n<p>Heard<br \/>\n\tMr.Brahmbhatt for the petitioner, Mr.Pujari, learned AGP for<br \/>\n\trespondents Nos. 1 &amp; 2 and Mr.Prajapati for respondent No.3.\n<\/p>\n<p>Upon<br \/>\n\thearing the learned counsel appearing for both the sides, it appears<br \/>\n\tthat the principal contention of the petitioner is that without<br \/>\n\tgiving any opportunity of hearing, the State Government has<br \/>\n\texercised the appellate power and has allowed the appeal.  Neither<br \/>\n\tMr.Prajapati, nor the learned AGP are in a position to show that any<br \/>\n\thearing was given to the petitioner or that the petitioner had<br \/>\n\tremained present and thereafter, on the date of hearing, the<br \/>\n\topportunity was not availed of.\n<\/p>\n<p>Under<br \/>\n\tthese circumstances, the only conclusion can be recorded is that the<br \/>\n\tState Government has exercised the power without giving any<br \/>\n\topportunity of hearing.  The petitioner was the person in whose<br \/>\n\tfavour the authorisation was granted and without giving opportunity<br \/>\n\tof hearing to the petitioner, the State Government could not<br \/>\n\texercise the quasi judicial power. Therefore, such an exercise of<br \/>\n\tthe power is breach of the principles of natural justice and cannot<br \/>\n\tbe sustained in the eye of law.\n<\/p>\n<p>In<br \/>\n\tthe result, the impugned order passed by the State Government dated<br \/>\n\t06.02.2008 is quashed and set aside with the further direction that<br \/>\n\tthe appeal shall stand restored to the file of the State Government.<br \/>\n\t The State Government shall give the opportunity of hearing to both<br \/>\n\tthe sides and shall pass a fresh order in accordance with law as<br \/>\n\tearly as possible preferably within a period of three months from<br \/>\n\tthe receipt of the order of this Court.\n<\/p>\n<p>Petition<br \/>\n\tis allowed to the aforesaid extent. Rule made absolute accordingly.<br \/>\n\tNo order as to costs.
