Shelat,  learned advocate appearing on behalf of the appellant<br \/>\nhas submitted that in the facts and circumstances of the case,  he<br \/>\ndoes not press the present Appeal from Order.\n<\/p>\n<p>2.\tHowever,<br \/>\nhe has requested that a suitable direction be issued to the learned<br \/>\ntrial Court to decide and dispose of the suit as expeditiously as<br \/>\npossible within a stipulated time and on condition that a suitable<br \/>\ndirection be issued directing the respondent-original defendant to<br \/>\npay the mesne profit atleast at the rate of Rs. 800\/- per month and<br \/>\nclear the arrears  on that basis and to continue to pay the mesne<br \/>\nprofit atleast at the rate of Rs. 800\/-  per month till final<br \/>\ndisposal of the suit subject to ultimate outcome of the suit.\n<\/p>\n<p>3.\tShri<br \/>\nPankaj Soni, learned advocate appearing on behalf of the<br \/>\nrespondent-original defendant has submitted that to the best of his<br \/>\ninformation and knowledge, the respondent-original defendant  is<br \/>\npaying the mesne profit at the rate of Rs. 800\/- per month.  It is to<br \/>\nbe noted that the respondent has not filed any reply to the present<br \/>\nappeal satisfying the Court that the respondent-original defendant is<br \/>\nin fact paying the mesne profit at the rate of Rs. 800\/-   per month<br \/>\nas directed by the learned trial Court.  Be that as it may.  The<br \/>\npresent Appeal from Order is dismissed as not pressed and disposed of<br \/>\nwith the following directions;\n<\/p>\n<p>(i)\tThe<br \/>\nlearned trial Court to decide and dispose of Regular Civil Suit No.<br \/>\n40\/1996 on remand as expeditiously as possible but not later than<br \/>\n31st December, 2009.  All the parties concerned are<br \/>\ndirected to cooperate with the learned trial Court for early disposal<br \/>\nof the suit within the stipulated time as stated hereinabove.  The<br \/>\nlearned trial Court shall not grant unnecessary adjournment to any of<br \/>\nthe parties.\n<\/p>\n<p>(ii)\tThe<br \/>\nrespondent-original defendant shall clear the arrears by way of mesne<br \/>\nprofit at the rate of Rs. 800\/-  per month up to 30th<br \/>\nOctober, 2008 within a period of two months from today and continue<br \/>\nto pay the mesne profit at the rate of Rs. 800\/-  per month between<br \/>\n1st and 7th of each month commencing from<br \/>\nNovember, 2008 till the final disposal of the suit and the aforesaid<br \/>\nwould be without prejudice to the rights and contention of the<br \/>\nrespective parties.\n<\/p>\n<p>4.\tWith<br \/>\nthis, the present Appeal from Order is disposed of.\n<\/p>\n<p>5.\tThe<br \/>\nRegistry is directed to send the writ to the learned trial Court<br \/>\nimmediately.\n<\/p>\n<p> CIVIL<br \/>\nAPPLICATION No.  12417\/2008<\/p>\n<p>\tIn<br \/>\nview of the order passed in Appeal from Order, no order on the Civil<br \/>\nApplication.\n<\/p>\n<p>\t\t\t\t\t\t\t(M.R.\n<\/p>\n<p>SHAH, J.)<\/p>\n<p>siji<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Ivaben vs Jashbhai on 11 November, 2008 Author: M.R.
