APP for Appellant: 1, \nMR MANAJI G THAKORE for\nOpponents : 1 - 4. \n===============================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BHAGWATI PRASAD\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/07\/2008 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE BHAGWATI PRASAD)<\/p>\n<p>The<br \/>\n\tpresent appeal is filed by the State of Gujarat against the decision<br \/>\n\tof the Court of Sessions, Surendranagar, being decision dated<br \/>\n\t14\/2\/1986 acquitting the accused for the offence punishable under<br \/>\n\tSection 302 r\/w 34 and in the alternative u\/s 302, 109, 498-A, r\/w<br \/>\n\tsection 34 and 201 of Indian Penal Code,  passed in Sessions Case<br \/>\n\tNo. 49 of 1985.\n<\/p>\n<p>The<br \/>\n\tfacts  involved in the present case are as under.\n<\/p>\n<p>  \tIt is the<br \/>\nprosecution case that accused No.1 and deceased Subhanben got married<br \/>\nbefore eight years from the date of incident. The married life of<br \/>\nhusband and wife was a strained one and therefore the wife left the<br \/>\nplace of her husband and went to her parental house. Thereafter,<br \/>\nelders of the family members intervened and resolved the problem by<br \/>\nsuggesting a way out that if any family member who is known to both<br \/>\nthe family may stood surety and therefore the accused No.2 and one<br \/>\nHavaben Amatbhai stood as surety and thereafter deceased came only<br \/>\nbefore one month at the place of in-laws. Thereafter before the<br \/>\nincident of two days i.e. 18\/4\/1984, complainant Rasulbhai Alubhai<br \/>\nsent his youngest daughter Mumtas to know the well beings of her<br \/>\nsister. Upon verifying personally, Mumtas informed her father that<br \/>\nthe accused No.1 may kill her sister and therefore, on the next date<br \/>\ni.e. 19\/4\/1984 requested her sister in law (Sali) Chandiben to bring<br \/>\nhis daughter back at her parental house but the accused denied by<br \/>\nsaying that they shall permit her to go only in presence of surety<br \/>\nHavaben and therefore, deceased was present at her in-laws house on<br \/>\nthe date of incident i.e. 20\/4\/1984 where according to the<br \/>\nprosecution case, deceased had tried to run away from the place of<br \/>\nher in-laws in the morning between 9 ?  10 A.M.  But unfortunately<br \/>\nshe could not catch the bus. Thereafter she tried to board the GEB<br \/>\nvehicle, at that  relevant time the accused No.2 and 3 reached there<br \/>\nand took her back to their house. Thereafter the incident in question<br \/>\nhad taken place first by throttling her neck by the accused and<br \/>\nthereafter kerosene was sprinkled upon her and set her on fire to<br \/>\ndemolish the evidence of murder. It is the further case of the<br \/>\nprosecution that after completion of the incident, two witnesses,<br \/>\nnamely P.W No.3 Chandibhai Amatbhai and P.W. No. 7 Havaben Amatbhai<br \/>\nwho came there to bring deceased at her parental house according to<br \/>\nthe instruction of the complainant and before they reach at the house<br \/>\nof deceased, on the way accused No.2 and 3 met both these witnesses<br \/>\nbut did not speak anything to these two witnesses and went to wash<br \/>\ntheir cloths. The two witnesses thereafter they reached at the house<br \/>\nof deceased where accused No.4 was shouting at the deceased ?S<br \/>\nSUBHAN BALECHE?? and they found that deceased was already burnt and<br \/>\nher dead body was lying in the room near the door. Both these<br \/>\nwitnesses found there was no smell of kerosene  and cloths of the<br \/>\ndeceased which were burnt were put by digging a pit on the back side<br \/>\nof the room which she could find when she went there to answer the<br \/>\nnature&#8217;s call. Thereafter accused No.2 and 3 reached there at 11.00<br \/>\nA.M., accused No.1 reached there at 12.00 A.M. and  started crying.<br \/>\nThereafter accused No.1 informed the concerned police station where<br \/>\nit was initially registered as Accident Case No. 2\/84 and the police<br \/>\ncame there and necessary panchnama of the scene of offence had drawn<br \/>\nbelow Exh. 25 and inquest panchnama was drawn below Exh. 27. The body<br \/>\nwas sent for postmortem at Ahmedabad where post-mortem was performed<br \/>\nbetween 5.15 to 6.15 P.M. on 20\/4\/1984.\n<\/p>\n<p>2.1\tThereafter<br \/>\nnecessary investigation was carried out and charge sheet came to be<br \/>\nfiled and the case was committed. The accused pleaded not guilty to<br \/>\nthe offence, the trial was conducted by the Learned Sessions Judge,<br \/>\nSurendranagar in which 15 witnesses have been examined along with<br \/>\nthat other documentary evidences were also produced. After conclusion<br \/>\nof the trial, Learned Sessions Judge was pleased to acquit the<br \/>\naccused by order dated 14\/2\/1986.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the said order of acquittal, the<br \/>\n\tState has preferred the present appeal on the following main amongst<br \/>\n\tother grounds:-\n<\/p>\n<p>\tIt is submitted by<br \/>\nMs. Panchal, learned APP that the incident had occurred in the<br \/>\nmorning in a most suspicious way. As per the allegation made in the<br \/>\ncomplaint the deceased on 20\/4\/1984 in the morning hours between 9 ?<br \/>\n10 A.M. tried to run away from her in-laws place along with her son<br \/>\nbut she missed the bus. Therefore she tried to get a lift on GEB<br \/>\nvehicle and when she was staring inside the vehicle, at that time the<br \/>\naccused No.2 and 3 reached there and dragged her out and subsequently<br \/>\nthe entire incident had occurred. In support of this contention, the<br \/>\nprosecution has examined P.W No.3 and P.W. No.7 along with other<br \/>\nwitnesses. P.W No.2 complainant had supported the case of the<br \/>\nprosecution but the evidence of medical officer Dr. Kiritbhai, P.W.<br \/>\nNo.4 who had performed the postmortem and in his report below exhibit\n<\/p>\n<p>-13 deposed that, according to him except burn injuries which were<br \/>\nmentioned in column no. 17 as first and third degree there were no<br \/>\nexternal injuries or marks were found on the body and reason for<br \/>\ncause of death given was ?Sdue to shock and haemo concentration due<br \/>\nto hurns.?S  Therefore the case of the prosecution of throttling and<br \/>\nthen deceased was killed was not supported by medical evidence. It is<br \/>\ncontended by learned APP that learned Judge ought to have believed<br \/>\nthe deposition of prosecution witness No.2, 3 and  7 and ought to<br \/>\nhave convicted the accused persons, since the prosecution has proved<br \/>\nits case beyond reasonable doubt.\n<\/p>\n<p>Having<br \/>\n\theard the learned counsel of the appellant and the respondents, and<br \/>\n\tafter perusing the records and proceedings, we have to consider<br \/>\n\twhether the incident was possible in the manner alleged by the<br \/>\n\tprosecution.  The dead body was found from the room.  To enter into<br \/>\n\tthe room the doors were broke open. The position of the room<br \/>\n\tindicates that it was not possible for the accused to first kill the<br \/>\n\tlady and then put her inside the room and bolt the room from<br \/>\n\tinside. The incident would only happen if the lady immolate herself<br \/>\n\tby bolting the room from inside. Considering the position of the<br \/>\n\troom of the house where the incident has occurred it was only<br \/>\n\tpossible in the aforesaid manner than any other manner as alleged by<br \/>\n\tthe prosecution.\n<\/p>\n<p>The<br \/>\n\tprosecution has come out with a case that the lady was first<br \/>\n\tstrangulated by the accused and then she was burnt to destroy the<br \/>\n\tevidence. To support this version the prosecution is not supported<br \/>\n\tby the medical evidence. According to the medical evidence there was<br \/>\n\tno marking of strangulation. The deceased had put herself in to<br \/>\n\tfire. The fire had taken place inside the room. The room was not<br \/>\n\tpossible to be  opened from outside unless the deceased open it from<br \/>\n\tinside. Thus it was a case of suicide. There have been no charge of<br \/>\n\tabetment of suicide. This case squarely can not be proved as it<br \/>\n\tstands for the offence punishable under section 302 I.P. Code and<br \/>\n\ttherefore acquitting from the charge under section 302 r\/w section<br \/>\n\t34 I.P. Code can not be interfered with. For the same reasons the<br \/>\n\tfindings of the Sessions Judge for acquitting the accused from other<br \/>\n\toffences also can not be interfered with.  In the instant case no<br \/>\n\tcase is made out by the State for  interference in the judgment of<br \/>\n\tacquittal passed by the trial Court. We do not find any infirmity or<br \/>\n\tillegality in the findings recorded by the Learned Sessions Judge,<br \/>\n\tand the reasonings rendered by the trial Court  are not likely to be<br \/>\n\tinterfered with.\n<\/p>\n<p>Consequently<br \/>\n\tthe appeal stands dismissed.
