No.1005 of 2011\n                                       KANGRESH SAH\n                                              Versus\n                                    THE STATE OF BIHAR\n                                            -----------\n<\/pre>\n<p>02\/    11.02.2011          Heard learned counsel for the petitioner as well as learned<\/p>\n<p>                    P.P. for the State.\n<\/p>\n<p>                               Petitioner seeks his bail in connection with Bakhtiarpur P.S.<\/p>\n<p>                    Case no. 204\/2008 registered under section 307 and other minor<\/p>\n<p>                    sections of the IPC and 27 of the Arms Act.\n<\/p>\n<p>                               As per prosecution case itself, it was co-accused Jai Prakash<\/p>\n<p>                    Sah who opened fire causing fire arm injury to the informant. So far as<\/p>\n<p>                    the petitioner is concerned, omnibus allegation of firing against<\/p>\n<p>                    petitioner and other two co-accused has been levelled and it is<\/p>\n<p>                    admitted position that firing of the petitioner did not hit the informant.<\/p>\n<p>                               Considering the aforesaid facts and circumstances as well as<\/p>\n<p>                    submissions of the parties, petitioner Kangresh Sah is directed to be<\/p>\n<p>                    released on bail on furnishing bail bond of Rs 10,000\/- with two<\/p>\n<p>                    sureties of the like amount each to the satisfaction of the Chief<\/p>\n<p>                    Judicial Magistrate, Saharsa in connection with Bakhtiarpur P.S.
