{"id":191153,"date":"2011-09-28T00:00:00","date_gmt":"2011-09-27T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/gautam-mandal-vs-the-state-of-bihar-on-28-september-2011"},"modified":"2017-05-14T17:37:24","modified_gmt":"2017-05-14T12:07:24","slug":"gautam-mandal-vs-the-state-of-bihar-on-28-september-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/gautam-mandal-vs-the-state-of-bihar-on-28-september-2011","title":{"rendered":"Gautam Mandal vs The State Of Bihar on 28 September, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Gautam Mandal vs The State Of Bihar on 28 September, 2011<\/div>\n<pre>                   IN THE HIGH COURT OF JUDICATURE AT PATNA\n                        Criminal Miscellaneous No.23730 of 2011\n                                      Gautam Mandal\n                                            Versus\n                                   The State Of Bihar\n                                ----------------------------------\n<\/pre>\n<p>4   28-09-2011               Heard learned counsel for the petitioner as well as<\/p>\n<p>                 learned Additional Public Prosecutor for the state.<\/p>\n<p>                             Petitioner is in jail custody since 17.06.2011 in a<\/p>\n<p>                 case registered under section-302 &amp; other minor sections of<\/p>\n<p>                 the Indian Penal Code and 27 of the Arms Act.\n<\/p>\n<p>                             There is allegation against this petitioner that he<\/p>\n<p>                 opened fire on deceased but submission on behalf of the<\/p>\n<p>                 petitioner is that the informant is not an eye witness of the<\/p>\n<p>                 alleged occurrence and prior to giving his fardbeyan, the<\/p>\n<p>                 informant gave telephonic information to Officer-in-charge of<\/p>\n<p>                 concerned police station disclosing this fact that some<\/p>\n<p>                 unknown persons had committed the murder of his brother-in-<\/p>\n<p>                 law but subsequently, when the police recorded the fardbeyan<\/p>\n<p>                 of the informant, he implicated the petitioner and other co-<\/p>\n<p>                 accused persons on account of previous enmity and village<\/p>\n<p>                 politics. It is further contended by him that having more or less<\/p>\n<p>                 similar allegation, some co-accused persons have already<\/p>\n<p>                 been granted privilege of bail by another benches of this court<\/p>\n<p>                 which is evident from perusal of Annexures-2 &amp; 3 to this<\/p>\n<p>                 petition.\n<\/p>\n<p>                             It would appear from perusal of Annexure-2 to this<br \/>\n<span class=\"hidden_text\">                                         2<\/span><\/p>\n<p>                    petition that one co-accused, Madan Mandal has been granted<\/p>\n<p>                    bail by another bench of this court vide order dated 19.01.2011<\/p>\n<p>                    passed in Cr. Misc. No. 42508 of 2010 and there was<\/p>\n<p>                    allegation of firing against the aforesaid Madan Mandal also<\/p>\n<p>                    and furthermore, it would appear from perusal of Annexure-2<\/p>\n<p>                    to this petition that while granting the bail to the aforesaid co-<\/p>\n<p>                    accused, Madan Mandal, the another bench of this court took<\/p>\n<p>                    into account the earlier Sanha made by the police on the basis<\/p>\n<p>                    of telephonic information given by informant of this case.<\/p>\n<p>                               Considering the aforesaid facts and circumstances<\/p>\n<p>                    as well as submissions of the parties, the petitioner, namely<\/p>\n<p>                    Gautam Mandal is directed to be released on bail on furnishing<\/p>\n<p>                    bail bond of Rs 10,000\/- (ten thousand) with two sureties of the<\/p>\n<p>                    like amount each in connection with Bariarpur P.S. Case No.<\/p>\n<p>                    99 of 2009 corresponding to Sessions Trial No. 589 of 2010 to<\/p>\n<p>                    the satisfaction of Sri M.M.S.
