Justice M.SASIDHARAN NAMBIAR\n\n Dated :08\/04\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n              CRL.M.C.NO.890 OF 2010\n           ---------------------------------------------\n               Dated 8th April 2010\n\n\n                          O R D E R\n<\/pre>\n<p>         Petitioners are the accused 1,2,5<\/p>\n<p>and  6  in    C.C.69\/1997                 on       the    file  of<\/p>\n<p>Judicial First Class Magistrate, Ponnani.<\/p>\n<p>As  petitioners            were          absconding,          case<\/p>\n<p>against them were split up and re-filed<\/p>\n<p>and subsequently removed to the register of<\/p>\n<p>long   pending           cases            as          L.P.23\/2006.<\/p>\n<p>Accused  3   and        4      were         tried        and  were<\/p>\n<p>acquitted. Petition is filed under Section<\/p>\n<p>482 of Code of Criminal Procedure to quash<\/p>\n<p>the  proceedings          against            the        petitioners<\/p>\n<p>contending that first respondent de facto<\/p>\n<p>complainant has settled all the disputes<\/p>\n<p>with the petitioners and therefore, it is<\/p>\n<p>not in the interest of justice to continue<\/p>\n<p>Crmc 890\/10<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>the prosecution. First respondent appeared<\/p>\n<p>through a counsel and filed an affidavit<\/p>\n<p>stating     that  the  incident  arose  out  of<\/p>\n<p>personal rivalry of the accused with him and<\/p>\n<p>he has settled entire disputes with the<\/p>\n<p>accused and he has no subsisting grievance<\/p>\n<p>against them       and therefore, he has no<\/p>\n<p>objection for quashing the proceedings.<\/p>\n<p>           2. Annexure    A    final     report<\/p>\n<p>submitted by the police on which cognizance<\/p>\n<p>was taken by the      learned Magistrate, show<\/p>\n<p>that     prosecution case is that at about 6.30<\/p>\n<p>p.m     on 16\/4\/1997 the seven accused formed<\/p>\n<p>themselves into an unlawful assembly with<\/p>\n<p>the common object of committing trespass<\/p>\n<p>into the property of the second respondent<\/p>\n<p>and in furtherance     of common object   they<\/p>\n<p>trespassed     into  the  property  of   second<\/p>\n<p>Crmc 890\/10<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>respondent in R.S.No.220\/1 and scolded him<\/p>\n<p>using      obscene words and also threatened him<\/p>\n<p>by showing a knife      that he will be murdered<\/p>\n<p>and thereby committed the offences under<\/p>\n<p>Sections 143, 147, 148, 447         and 506(ii)<\/p>\n<p>read with Section 149 of Indian Penal Code.<\/p>\n<p>Offences alleged against the petitioners are<\/p>\n<p>purely personal in nature as against second<\/p>\n<p>respondent.      Affidavit filed by the second<\/p>\n<p>respondent establishes that entire disputes<\/p>\n<p>with petitioners were settled amicably. As<\/p>\n<p>held by the      Apex court in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot<\/p>\n<p>v. State of Punjab<\/a> (2008 (3) KLT 19 (SC)<\/p>\n<p>when       all   the   disputes   between    the<\/p>\n<p>petitioners      and   second  respondent   were<\/p>\n<p>amicably      settled  and  consequent  to   the<\/p>\n<p>settlement, there is no likelihood of a<\/p>\n<p>successful prosecution, it is not in the<\/p>\n<p>Crmc 890\/10<br \/>\n<span class=\"hidden_text\">                          4<\/span><\/p>\n<p>interest     of   justice  to   continue   the<\/p>\n<p>prosecution.\n<\/p>\n<p>           Petition is allowed.
