He had filed a complaint of a document<br \/>\nhaving been created by his false signature.  Document pertains to<br \/>\nagreement to sale a scooter by the accused to the petitioner.\n<\/p>\n<p>2.\tIt<br \/>\nappears that scooter was involved in a hit and run accident.  Police<br \/>\nauthorities upon preliminary investigations suspect the petitioner to<br \/>\nbe the driver involved in the accident.  This was on the basis of the<br \/>\nregistered owner of the vehicle disclosing to the police that scooter<br \/>\nwas already under agreement to sale entered into in the year 2002 and<br \/>\npossession thereof was with the petitioner since then.\n<\/p>\n<p>3.\tPetitioner<br \/>\nthereupon filed a complaint before the police alleging forgery and<br \/>\ncontending that the signature on the document was not his.\n<\/p>\n<p>4.\tPolice,<br \/>\nhowever, upon completion of investigation submitted &#8216;C&#8217; summary<br \/>\nreport, which was accepted by the Magistrate despite objections from<br \/>\nthe petitioner.  Revision application was filed by the petitioner<br \/>\nwhich was dismissed by the learned Additional Sessions Judge, Nadiad<br \/>\nhence, the petition.\n<\/p>\n<p>5.\tLearned<br \/>\ncounsel for the petitioner submitted that the police did not carry<br \/>\nout proper investigation and ought to have sent the disputed document<br \/>\ni.e. agreement to sale for handwriting expert&#8217;s opinion.  Petitioner<br \/>\nis being falsely involved in an accident case.  He submitted that in<br \/>\nany case, &#8216;C&#8217; summary ought not to have been accepted by the<br \/>\nMagistrate.\n<\/p>\n<p>6.\tOn<br \/>\nthe other hand, learned advocate appearing for the respondents<br \/>\nopposed the petition.  I have also heard learned APP for the State.\n<\/p>\n<p>7.\tFrom<br \/>\nthe materials on record I find that upon police investigation, it was<br \/>\nconcluded that the complaint was not genuine and that the same was<br \/>\nfiled only to avoid liability arising out of fatal accident.  Learned<br \/>\nMagistrate has while examining the report of the police observed that<br \/>\nthe investigating officer has recorded statement of several witnesses<br \/>\nand on the basis of such evidence collected, it was found that the<br \/>\nscooter in question was sold to the petitioner on 09.01.2002 for an<br \/>\namount of Rs.14,001\/- and towards sale price he has also paid<br \/>\nRs.10,001\/- and all liabilities to pay tax etc. were on the<br \/>\npurchaser.  The vehicle thereafter was involved in a fatal accident<br \/>\non 10.04.2005 in the outskirts of village Vaso.  Such a statement was<br \/>\ngiven by the petitioner himself on 06.03.2006.  Thereafter he has<br \/>\nfiled present complaint on 02.05.2006.  Not only that, other<br \/>\nwitnesses have also supported the version that the scooter was sold<br \/>\nto the petitioner by Pravinbhai Gopalbhai.  Thereafter when the heirs<br \/>\nof the deceased filed filed the claim petition, to avoid such<br \/>\nliability present complaint has been filed.  From the panchnama of<br \/>\nseizure of the scooter drawn in the accident case, it appears that<br \/>\nthe same was produced by the petitioner himself before the police.<br \/>\nThe learned Magistrate in short was of the opinion that the police<br \/>\nreport of &#8216;C&#8217; summary should be accepted.\n<\/p>\n<p>\tRevision<br \/>\napplication of the petitioner before the Sessions Court also failed<br \/>\nfor similar reasons.\n<\/p>\n<p>8.\tWhen<br \/>\ntwo Courts below by giving concurrent findings on scrutiny of<br \/>\nevidence collected and facts on record, have decided the &#8216;C&#8217; summary,<br \/>\nI see no reason to interfere. When no perversity is pointed out in<br \/>\nsuch factual conclusions, I am broadly in agreement with view of the<br \/>\nCourts below.  Learned petitioner&#8217;s counsel&#8217;s insistence of sending<br \/>\nthe document in dispute for handwriting expert&#8217;s opinion cannot be<br \/>\ncountenanced since there is sufficient other material on record to<br \/>\nestablish that the allegations in the complaint were not correct.\n<\/p>\n<p>9.\tIn<br \/>\nthe result petition fails, dismissed.
