HANSARIA\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     The  only\tquestion  in  this  appeal  is\twhether\t the<br \/>\nrespondents are\t governed by the Rules for the regulation of<br \/>\nthe recruitment\t to the\t clerical service of the Secretariat<br \/>\nand certain  other offices  of the Government of West Bengal<br \/>\nissued in Notification No. 2083-F dated July 21, 1954 or the<br \/>\nWest Bengal Boards Miscellaneous Rules, 1955 for appointment<br \/>\nto the\tLower Divisions.  The facts  are not in dispute. The<br \/>\nappellant called  for the names from the Employment Exchange<br \/>\nin the\tnotification for  recruitment. Calling\ttheir names,<br \/>\nthe appellants\tprescribed passing  of the written exams and<br \/>\ntyping with  30 w.p.m.\tspeed as  qualification\t apart\tfrom<br \/>\nother qualifications.  Pursuant thereto,  the names  of\t the<br \/>\ncandidates have\t been sent. 545 candidates were qualified in<br \/>\nthe written examination and were required to pass the typing<br \/>\ntest. After  conducting the  typing test, respondents 44-189<br \/>\nhad passed  the test  and the other respondents did not pass<br \/>\nthe test.  Consequently, they  could not  be appointed. When<br \/>\nthey had  approached the  High\tCourt  under  Art.  226\t for<br \/>\nnecessary directions, the learned single Judge dismissed the<br \/>\nwrit petition.\tBut on\tappeal, the Division Bench in F.M.A.<br \/>\nNo. 648\/91 by order dated April 27, 1992 set aside the order<br \/>\nof  the\t  learned  single   Judge  and\t directed  that\t the<br \/>\nappointment  of\t respondents  44-189  were  not\t upset.\t Yet<br \/>\ndirected  that\t the  respondents   be\tappointed.   Feeling<br \/>\naggrieved, this appeal by special leave has been filed.\n<\/p>\n<p>     Pursuant to  our directions dated November 2, 1995, the<br \/>\nappellants have placed on record the relevant Rules relating<br \/>\nto the\tSchedule 2,  2-A as  enumerated in  Rule  4  of\t the<br \/>\nSecretariat Rules  referred  to\t hereinbefore.\tIn  form  of<br \/>\nnotification it is stated in column 3(c) thus:\n<\/p>\n<blockquote><p>     &#8220;Qualification required:\n<\/p><\/blockquote>\n<blockquote><p>     School Final  or  its  equivalent.\t Must<br \/>\n     have knowledge  in English Typing with a<br \/>\n     minimum speed  of\t30  words  p.m.\t Such<br \/>\n     knowledge in typing is not essential for<br \/>\n     the physically handicapped persons.&#8221;<\/p><\/blockquote>\n<p>     Under Rule\t 65 of the West Bengal Board&#8217;s Miscellaneous<br \/>\nRules, 1955  qualifications for permanent appointment to the<br \/>\nLower Division are specified of which condition (d) provides<br \/>\nthat:\n<\/p>\n<blockquote><p>     &#8220;In  the\tcase  of   vacancies  in  the<br \/>\n     district or  sub-divisional  offices  an<br \/>\n     examination of candidates should be held<br \/>\n     after  due\t  notice  within  the  period<br \/>\n     mentioned in  rule 62 to select the best<br \/>\n     persons for  the posts.  The examination<br \/>\n     will be  held in  English and Bengali to<br \/>\n     test (a)  handwriting, (b)\t knowledge in<br \/>\n     English   and    Bengali\t(c)   general<br \/>\n     knowledge and  intelligence. There\t will<br \/>\n     be one  paper  to\tbe  answered  in  two<br \/>\n     hours. The\t tet for  typewriting will be<br \/>\n     for half  an hour. A candidate should be<br \/>\n     able  to\ttranscribe  accurately\t from<br \/>\n     legible handwriting  at a\trate  of  not<br \/>\n     less than\t30 words  per minute  and the<br \/>\n     paper will\t be marked  on the basis of a<br \/>\n     penalty of\t five words for every mistake<br \/>\n     e.g. misspelling,\twrong spacing,\twrong<br \/>\n     paragraphing.  One\t  letter  typed\t over<br \/>\n     another, etc.  The\t manuscript  will  be<br \/>\n     such as  is used  in ordinary Government<br \/>\n     Correspondence  and  the  percentage  of<br \/>\n     errors permissible\t shall\tnot  be\t more<br \/>\n     than 5  percent. The examinations should<br \/>\n     be held  by the  District officer\tor by<br \/>\n     any senior\t Gazetted officer  to whom he<br \/>\n     may delegate the duty.&#8221;<\/p><\/blockquote>\n<p>     As noted  earlier, pursuant  to the  advertisement\t and<br \/>\nprescription of\t the qualification,  the respondent Nos.1 to<br \/>\n43 had\tappered and  sat  for  the  examination.  They\twere<br \/>\nqualified in the written examination. They had also appeared<br \/>\nfor the typing test and therein they were not qualified. The<br \/>\nquestion thus  emerges\twhether\t the  West  Bengal  Services<br \/>\n(Secretariat Common  Cadre)  Rules,  1984  (for\t short\t`the<br \/>\nRules&#8217;) issued\tunder proviso to Art.309 of the Constitution<br \/>\nwould be  applicable to the method of recruitment of L.D.Cs.<br \/>\nto be  appointed in the district and sub-divisional offices.<br \/>\nThe  Rules   themselves\t clearly   envisage  that  they\t are<br \/>\napplicable to  Secretariat Common  Cadre Rules. Rule 4 which<br \/>\nis relevant in this case postulates that notwithstanding the<br \/>\nprovisions of  the West\t Bengal (Classification\t Control and<br \/>\nAppeal) Rules,\t1971, the  competent authority\tto make\t the<br \/>\nrecruitment  is\t envisaged  in\tRule  7.  Rule\t4  would  be<br \/>\napplicable to  the list\t of  departments  specified  in\t the<br \/>\nSchedule.  Schedule   has  been\t appended  and\tclause\t(iv)<br \/>\nenvisages `Department  of Land and Land Reforms&#8221;. At the end<br \/>\nit is  stated under the head `Offices&#8217; `1. Board of Revenue,<br \/>\nWest Bengal&#8217;.\n<\/p>\n<p>     Relying upon  these rules,\t Shri M.N.  Krishnamani, the<br \/>\nlearned Senior\tcounsel for  the respondents  1-43 contended<br \/>\nthat the  respondents working  in the Department of Land and<br \/>\nLand  Reforms  are  controlled\tby  the\t Board\tof  Revenue.<br \/>\nTherefore, they\t are required  to be  governed by  the Rules<br \/>\nwhich though  initially prescribed  pass of  the typing test<br \/>\nbut it is not a condition for appointment. The qualification<br \/>\ncould be  acquired during  probation. That rule subsequently<br \/>\nwas deleted, consequently, the respondent Nos. 1-43 need not<br \/>\npass the accounts test. We find no force in the contention.\n<\/p>\n<p>     It is  seen that  the Rules  themselves  would  clearly<br \/>\nindicate that they are applicable to the Secretariat and the<br \/>\nOffices mentioned  in the  Schedule. Department\t of Land and<br \/>\nLand Reforms  mentioned in  the Schedule  is a Department in<br \/>\nthe Secretariat.  In the `Offices&#8217; it is mentioned the Board<br \/>\nof Revenue.  It would  thus be\tseen that  Secretariat is  a<br \/>\nseparate wing  and the\tBoard of  Revenue is the Head of the<br \/>\nDepartment. That  gets manifested when we see Schedule 2 and<br \/>\nSchedule 2-C  attached to  the West  Bengal  Public  Service<br \/>\nCommission Regulation,\t1937. It  clearly enumerates various<br \/>\nclerical establishment,\t stenographers\tand  typist  of\t the<br \/>\nSecretariat and typists in all the departments. They are all<br \/>\nheads of  Departments. That  was also manifested in Schedule<br \/>\n2-C including  the Inspector  General  of  Prisons  and\t the<br \/>\nConservator of\tForests. It  would thus\t be  seen  that\t the<br \/>\nregulations   for   recruitment\t  through   Public   Service<br \/>\nCommission  are\t  in  respect\tof  clerical  establishment,<br \/>\nstenographers and  typists of  the Secretariat and the heads<br \/>\nof the departments. Regulation 31 excludes other departments<br \/>\nwhich envisages thus:\n<\/p>\n<blockquote><p>     &#8220;It shall\tnot be\tnecessary to  consult<br \/>\n     the  Commission   with  respect  to  the<br \/>\n     matters specified in clauses (a) and (b)<br \/>\n     of sub-section (3) of section 266 of the<br \/>\n     Act for any service or post not included<br \/>\n     in\t Schedule   &#8220;C&#8221;\t annexed  hereto  the<br \/>\n     appointing authority  for\twhich  is  an<br \/>\n     authority subordinate  to the Provincial<br \/>\n     Government.&#8221;<\/p><\/blockquote>\n<p>     In other  words, except  those mentioned  in Schedule 2<br \/>\nand  2-C,  all\tother  departments  in\tother  respects\t the<br \/>\ndistrict  and\tsub-divisional\toffices\t stand\texcluded  by<br \/>\noperation of Regulation 31 of the West Bengal Public Service<br \/>\nCommission Regulation  1937. Once  they stand  excluded from<br \/>\nthe  recruitment  by  the  Public  Service  Commission,\t the<br \/>\nnecessary concomitant result would be that they are governed<br \/>\nby the\tBoard&#8217;s\t miscellaneous\tRules,\t1955.  They  clearly<br \/>\nenvisage  passing   of\ttyping\t as  a\t qualification\t for<br \/>\nappointment as\ta LDC  in the  district\t and  sub-divisional<br \/>\noffices. It  would, therefore, be clear that the recruitment<br \/>\nwas properly and legally made, respondent Nos. 1-43 and 114-<br \/>\n120 having appeared and failed in typing examination, cannot<br \/>\nnow  turn   round  and\tcontend\t that  the  said  rules\t are<br \/>\ninapplicable and  the Rules are applicable to them. Our view<br \/>\ngets support  also frm\tthe decision  of this  Court in C.A.<br \/>\n4531\/92, dated October 22, 1992.\n<\/p>\n<p>     In case  of future\t recruitment, it  may be open to the<br \/>\nrespondent  Nos.   1-43\t and   114-120\tto  appear  for\t the<br \/>\nexamination and\t claim their  right  to\t be  considered\t for<br \/>\nrecruitment as\tLDCs. In  the event if any of them happen to<br \/>\nbe barred  by age,  necessary relaxation of age may be given<br \/>\nand they may be considered according to rules.\n<\/p>\n<p>     The appeal\t is accordingly allowed and the order of the<br \/>\nDivision Bench\tis set\taside and that of the learned single<br \/>\nJudge stands confirmed.
