No.4345 of 2008\n                        -------------------------------------\n               Dated this the 13th day of November, 2008\n\n                                    ORDER\n<\/pre>\n<p>      Petitioner faces allegations in a crime alleging commission of<\/p>\n<p>offences punishable under the Kerala Abkari Act.                 Crime was<\/p>\n<p>registered as early as in 2006. According to the petitioner he is<\/p>\n<p>absolutely innocent. He was not earlier arrayed as an accused.<\/p>\n<p>Now attempts are being made to array him as an accused and to<\/p>\n<p>arrest him. The petitioner had moved this Court for anticipatory<\/p>\n<p>bail and the bail Bench of this Court had already dismissed that<\/p>\n<p>application. The petitioner has not challenged the said order. The<\/p>\n<p>petitioner has not so far appeared before the learned Magistrate or<\/p>\n<p>the Investigating Officer and he has not sought regular bail.<\/p>\n<p>      2.    The petitioner has now come to this Court with a prayer<\/p>\n<p>that directions under Section 482 Cr.P.C may be issued in his<\/p>\n<p>favour. What are the directions to be issued ? The counsel prays<\/p>\n<p>that the learned Magistrate may be directed to consider the<\/p>\n<p>application for bail on the date of surrender itself.<\/p>\n<p>      3.    I find no merit in this prayer. It is for the petitioner to<\/p>\n<p>surrender before the Investigating Officer or the learned Magistrate<\/p>\n<p>and seek regular bail. This Court has time and again repeated that<\/p>\n<p>applications for bail of an accused person, who surrenders before<\/p>\n<p>the learned Magistrate must be considered on merits, in accordance<\/p>\n<p>with law and expeditiously.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.4345 of 2008        2<\/span><\/p>\n<p>     4.    Sufficient general directions have already been issued in<\/p>\n<p><a href=\"\/doc\/1851848\/\">Alice George v. The Deputy Superintendent of Police<\/a> [2003(1)<\/p>\n<p>KLT 339]. I am not satisfied that it is necessary for this Court in<\/p>\n<p>every subsequent case to issue directions under Section 482 Cr.P.C<\/p>\n<p>to the Magistracy to follow the dictum in <a href=\"\/doc\/1851848\/\">Alice George v. The<\/p>\n<p>Deputy Superintendent of Police<\/a> .         Every court must do the<\/p>\n<p>same. I have no reason to assume that the same shall not be done.<\/p>\n<p>If there be non compliance, the avenues of challenge\/complaint are<\/p>\n<p>available for the petitioner.\n<\/p>\n<p>     5.    This Crl.M.C is, in these circumstances, dismissed, but<\/p>\n<p>with the above specific observations.\n<\/p>\n<p>     6.
