The Deputy Commercial Tax Officer-II,\n    Ettayapuram Road,\n    Kovilpatti,\n    Tuticorin District.\t\t\t\t  ..Respondents.\t\n\nPrayer\n\nWrit Petition filed under Article 226 of the Constitution of India,\npraying this Court to issue a Writ of Mandamus directing the respondents to\nexempt the vermicelli Ada from the payment of Tax under the Tamil Nadu Value\nAdded Vax, 2006, without reference to the clarification issued by the second\nrespondent, dated 12.03.2007.\n\n!For Petitioner  ... M\/s.M.Md.Ibrahim Ali\n^For Respondents ... Ms.S.Bharathi\n\t\t     Govt.Advocate\n\n:ORDER\n<\/pre>\n<p>\tThe petitioner has invoked the writ jurisdiction of this Court under<br \/>\nArticle 226 of the Constitution of India, to challenge the clarification, dated<br \/>\n12.03.2007, addressed to Tvl.Aurofood Private Limited,  pointing out that &#8216;Ada&#8217;<br \/>\nand &#8216;Vermicelli&#8217; were taxable at 12.5% under  Part-C of Schedule-II of Tamil<br \/>\nNadu Value Added Tax, 2006, w.e.f. 01.01.2007.\n<\/p>\n<p>\t2.  The only ground on which the clarification is challenged by the<br \/>\npetitioner, is that on an earlier occasion, vide letter D.Dis.\/Acts Cell-<br \/>\nV\/23842\/95, dated 18.04.1995, addressed to the petitioner, it was clarified that<br \/>\n&#8216;Vermicelli&#8217; and &#8216;Vermicelli Ada&#8217; were one and the same item, whereas by way of<br \/>\nsubsequent impugned notification, this clarification is sought to be<br \/>\nmodified\/done away with.\n<\/p>\n<p>\t3.  The contention is misconceived.\n<\/p>\n<p>\t4. The impugned clarification deals with &#8216;Ada&#8217; and  &#8216;Macroni&#8217; which has<br \/>\nnothing to do with &#8216;Vermicelli&#8217; and &#8216;Vermicelli Ada&#8217;.\n<\/p>\n<p>\t5. The clarification is also not addressed to the petitioner nor the<br \/>\npetitioner is manufacturer of &#8216;Ada&#8217; or &#8216;Macroni&#8217;. Therefore, the petitioner has<br \/>\nno locus standi to challenge the clarification, address to a third party.\n<\/p>\n<p>\t6.  The Writ Petition being totally misconceived is ordered to be<br \/>\ndismissed.\n<\/p>\n<p>\t7.  Consequently connected Miscellaneous Petition is dismissed.\n<\/p>\n<p>\t8.
