Justice ANTONY DOMINIC\n\n Dated :29\/07\/2008\n\n O R D E R\n                     ANTONY DOMINIC, J\n\n    -----------------------------------------------------------\n                     W.P.(C).No.6996\/2008\n    -----------------------------------------------------------\n            Dated this the 29th    day of July, 2008\n\n\n                           JUDGMENT\n<\/pre>\n<p>     The prayer in this writ petition is for a direction to the<\/p>\n<p>respondents not to issue the temporary\/special permits to<\/p>\n<p>the stage carriage operators enabling them to avoid their<\/p>\n<p>bounden duty of operating in the specified routes and to<\/p>\n<p>operate like a contract carriage. A declaration that Section<\/p>\n<p>88(8) of the Motor Vehicles Act, 1988 does not visualize the<\/p>\n<p>granting of special permit to the stage carriage operators to<\/p>\n<p>function like a contract carriage within the jurisdictional area<\/p>\n<p>of the Regional Transport Authority by whom it is issued, is<\/p>\n<p>also sought for.\n<\/p>\n<p>     2. The main ground on which the petitioner is raising<\/p>\n<p>his contention is that, it is without ensuring the availability<\/p>\n<p>of a substitute vehicle, that special permits are issued to<\/p>\n<p><span class=\"hidden_text\">WP(c).No.6996\/2008          2<\/span><\/p>\n<p>contract carriages and that this was not permissible, in view<\/p>\n<p>of the judgment of this court in <a href=\"\/doc\/1389648\/\">Vijayan Pillai V. RTO,<\/p>\n<p>Trissur<\/a>(2003(1)KLT 184).\n<\/p>\n<p>     3. A statement has been filed by the first respondent.<\/p>\n<p>In that statement, it is stated that, it is strictly in<\/p>\n<p>compliance with the provisions contained in Section 88(8) of<\/p>\n<p>the Motor Vehicles Act and in compliance with the decision<\/p>\n<p>of the State Transport Authority, dated 1.2.2005 that special<\/p>\n<p>permits are issued to the stage carriages for a maximum<\/p>\n<p>period of 2 days and without insisting on substitute<\/p>\n<p>arrangements provided that one day is a holiday. It is also<\/p>\n<p>stated that, in a case where both the days covered by<\/p>\n<p>special permits are working days, the     granting authority<\/p>\n<p>shall ensure that the traveling public will not be put to<\/p>\n<p>hardship by the withdrawal of the route bus and that if it is<\/p>\n<p>satisfied that the withdrawal will put the traveling public to<\/p>\n<p>hardship, such special permits shall be granted only after<\/p>\n<p>making substitute arrangements.\n<\/p>\n<p><span class=\"hidden_text\">WP(c).No.6996\/2008            3<\/span><\/p>\n<p>     4. From the above, it is evident that the respondents<\/p>\n<p>are ensuring that the inconvenience that is likely to be<\/p>\n<p>caused to the traveling public on account of the withdrawal<\/p>\n<p>of the vehicle is dully taken care of.
