As the applicant could not<br \/>\nobtain certified copy and contact the lawyer, the appeal could not be<br \/>\nfiled in time, and therefore the delay was caused, and the delay<br \/>\nrequires to be condoned.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the respondent submitted that in pursuance of the decree<br \/>\npassed by the Court below, Execution Application No. 19 of 2008 was<br \/>\npreferred and in pursuance thereof, possession of the land in<br \/>\nquestion has already been taken over on 15.12.2009 and even panchnama<br \/>\nin respect thereof has been drawn. He submitted that in view of the<br \/>\naforesaid facts and circumstances, nothing remains in the Second<br \/>\nAppeal, and the application does not call for any interference and it<br \/>\ndeserves to be dismissed.\n<\/p>\n<p>\tHaving<br \/>\nconsidered the rival submission and on perusal of the averments made<br \/>\nin the application as well as the endorsement made by the bailfiff in<br \/>\nExecution Application No. 19 of 2008 and the panchnama by which<br \/>\npossession is taken over, nothing remains in the Second Appeal.\n<\/p>\n<p>\tIn<br \/>\nview of the aforesaid facts and circumstances of the case, no<br \/>\ninterference is called for and the same is liable to be dismissed.<br \/>\nRule is discharged.
