No. 5225 of 2008:\n<\/p>\n<blockquote><p>                                     This interlocutory application has been filed by Vimal<\/p>\n<p>                         Bharti for being added as respondent in this case.<\/p>\n<\/blockquote>\n<blockquote><p>                                     The intervention petition is allowed for the reason that<\/p>\n<p>                         she is a necessary party as she would be affected by any order<\/p>\n<p>                         passed in this writ petition.\n<\/p><\/blockquote>\n<blockquote><p>                                     The case of the respondent intervenor is that she has<\/p>\n<p>                         higher marks and, therefore, has been selected to the post of<\/p>\n<p>                         Aanganbari Sevika after cancellation of petitioner&#8217;s engagement<\/p>\n<p>                         by the District Programme Officer vide order, dated 9.1.2008<\/p>\n<p>                         contained in Annexure 8.\n<\/p><\/blockquote>\n<blockquote><p>                                     Counsel appearing on behalf of the petitioner relies on<\/p>\n<p>                         a judgment in the case of Prabha Kumari Devi vs. State of Bihar,<\/p>\n<p>                         2010 (1) PLJR 374 wherein a Division Bench of this court has<\/p>\n<p>                         held that the District Programme Officer does not have the power<\/p>\n<p>                         to pass any order of termination.<\/p><\/blockquote>\n<p>                                     Given the facts aforesaid, the District Magistrate,<\/p>\n<p>                         Samastipur is directed to hear the petitioner and the intervenor<\/p>\n<p>                         respondent, on receipt of a copy of this order, within a period of<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        four weeks.
