SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/07\/2008 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioner ?  original plaintiff has challenged the legality and<br \/>\nvalidity of the order dated 30.05.2008 passed by the learned 2nd<br \/>\nAdditional Civil Judge, Bardoli passed below Exh.21 in Regular Civil<br \/>\nSuit No.20 of 2008, by which the learned trial Court has allowed the<br \/>\nsaid application of some of the plot holders who are also party to<br \/>\nthe partition deed \/ arrangement.\n<\/p>\n<p>2.\t\tMr.N.V.Gandhi,<br \/>\nLearned Advocate appearing on behalf of the petitioners ?  original<br \/>\nplaintiff has submitted that the petitioners are not claiming any<br \/>\nrelief against said third party who are permitted to be joined as<br \/>\nparty defendants and that they are only challenging the notice issued<br \/>\nby the Nagarpalika and as no relief is sought against them, learned<br \/>\ntrial Court has erred in allowing the said application and permitted<br \/>\nthem to be joined as party defendants. It is submitted that there are<br \/>\ndispute amongst the members, however, they can initiate independent<br \/>\nproceedings. He has relied upon decision of the learned Single Judge<br \/>\nrendered in Special Civil Application No.26860 of 2007 as well as<br \/>\ndecision of other High Court in support of his contention that<br \/>\nplaintiffs are dominus litis and as no relief is sought<br \/>\nagainst third party, they are not required to be joined as party ?<br \/>\ndefendants.\n<\/p>\n<p>3.\t\tIt<br \/>\nis true that what is challenged by plaintiffs in the Suit, is the<br \/>\nnotice issued by Nagarpalika, however, plaintiffs are relying upon<br \/>\npartition deed \/ agreement between plot holders &#8211; third parties who<br \/>\nare ordered to be joined as defendants to the suit and that they are<br \/>\nseriously disputing the contention on behalf of the plaintiffs based<br \/>\nupon the aforesaid arrangement. Considering above, when the learned<br \/>\ntrial Court has thought it fit to join those persons as party<br \/>\ndefendants and treating them as necessary party and\/or parties for<br \/>\neffective hearing of suit, it cannot be said that the learned trial<br \/>\nCourt has committed any error. There is no dispute to the proposition<br \/>\nof law laid down by the Hon&#8217;ble Supreme Court of India as well as<br \/>\nview taken by this Court in Special Civil Application No.26860 of<br \/>\n2007. However, in the facts and circumstances of the case, this Court<br \/>\nis of the opinion that third party who are ordered to be joined as<br \/>\nparty defendants, are necessary parties atleast for the purpose of<br \/>\neffective hearing and determination of the suit. It is not that only<br \/>\nthose persons who are required to be joined as defendants against<br \/>\nwhom some relief is sought. Those persons whose presence is<br \/>\nconsidered necessary for effective hearing of the suit, they can be<br \/>\njoined as party defendants.  Considering above, learned trial Court<br \/>\nhas not committed any error in allowing application Exh.21 in Regular<br \/>\nCivil Suit No.20 of 2008 and permitting third party to be joined as<br \/>\ndefendants to the Suit.
