Learned SDM in exercise of the powers under Section 133 of the<br \/>\nCode of Criminal Procedure directed the petitioners to shift the unit<br \/>\nfrom the existing residential locality. Petitioners&#8217; revision<br \/>\napplication, as already noted, also came to be dismissed.\n<\/p>\n<p>\tCounsel<br \/>\nfor the petitioners submitted that the petitioners did not have any<br \/>\nopportunity to cross examine the complainant. He further submitted<br \/>\nthat height of Chimani is already increased from 15 ft to 25 ft.<br \/>\nsubstantially mitigating the inconvenience to the neighbours. He<br \/>\nfurther stated that the petitioners would take all necessary steps to<br \/>\nmaintain proper hygienic condition if allowed to operate the unit. He<br \/>\nsubmitted that eight workers are dependent for their livelihood on<br \/>\nthis activity.\n<\/p>\n<p>\tI<br \/>\nhave heard learned advocate for the petitioner, learned APP for the<br \/>\nState and learned advocate Mr.Divyesh Joshi for the private<br \/>\nrespondents who opposed the petition and drew my attention to the<br \/>\nvarious observations made by the learned Additional Sessions Judge.\n<\/p>\n<p>\tHaving<br \/>\nheard learned advocates for the parties, I am of the opinion that for<br \/>\nlimited purpose and for giving an opportunity to the petitioners to<br \/>\ncross examine the complainant, proceedings be remanded. While<br \/>\nconsidering the remand proceedings, it will be open for the SDM to<br \/>\ntake into account the changed circumstances of increased height of<br \/>\nthe Chimani. Over and above, it will be also be open for the<br \/>\npetitioners to suggest other corrective measures and the SDM<br \/>\nconcerned shall examine all such aspects of the matter and pass<br \/>\nappropriate order afresh in accordance with law.\n<\/p>\n<p>\tFor<br \/>\nthe above purpose, the order dated 27.05.2010 passed by the learned<br \/>\nAdditional Sessions Judge, Modasa is set aside and the proceedings<br \/>\nare remanded to SDM concerned to decide it afresh bearing in mind the<br \/>\nobservations made in this order and such decision afresh be taken as<br \/>\nexpeditiously as possible and preferably before 31st<br \/>\nDecember 2010.
