. it  wast” riding  cycle bearing No.KA–03\/ EC~6’I\/19,<\/p>\n
 the traffic rules, on the left side of the<\/p>\n
road, he  with an accident near KMF Bus stop,<\/p>\n
vV””Marath’aha11i, on account of rash and negligent driving<\/p>\n
 driver of Lorry bearing Registration No.CNX–<\/p>\n
  __5-‘f43- Due to the impact, he was thrown out and he<\/p>\n
sustained grievous injuries and was immediately shifted<\/p>\n
to St. John’s Hospital and in spite of best treatment, he<\/p>\n
succumbed to the iI1j’t1i’i\u20acS in the Hospital.<\/p>\n
3. The claim petition  <\/p>\n
respondents 1 and 2 hereinl”ea?1*ne
\nbefore the Tribunal.  The
\nTribunal, after   material
\navailable on   of the oral and
\ndocumentarsz  claim petition in
\npart,   W under different
\nheads, “per annum. from the date of<\/p>\n
petition gptillllthe ‘date ‘of realization. Being aggrieved by<\/p>\n
lathe of cornpensation awarded by Tribunal. the<\/p>\n

redaction of’compensation.\n<\/p>\n

  Veheriiently submitted that the Tribunal seriously erred

multiplier for ealeulatirig the compensation payable<\/p>\n
towards loss of dependency, instead of taking’-.into<\/p>\n
account the age of the younger parent of <\/p>\n
Therefore, having regard to the agemofgroiingerpareiit’ <\/p>\n
the deceased in the instant the.’v_’approp1:iate”‘~.<\/p>\n

respondents   dforconsiderable length of time.<\/p>\n
5 6′.  After yoritdical eyaluation of the original records<\/p>\n
 threadbare, and after perusal of the<\/p>\n
award passed by Tribunal, the only point<\/p>\n
thatiarise for our consideration is:<\/p>\n
lzlfhether the Compensation awarded by<\/p>\n
   .?5Tribur1aI is liable to be reduced?<\/p>\n
After careful evaluation of the original recordsj”pi.acge’d<\/p>\n
before us. it emerges that the o(:(:u1″re1ic:e-dot’accident? V’<\/p>\n
and the resultant death of the”deceas_ed_.l.are<_not\ufb02in-.g<\/p>\n
dispute. T he Tribunal, after  "oral<\/p>\n
documentarv evidence availatile on '–.\ufb01le,_"gha's lriflhtl V\n<\/p>\n
– ‘V ._ _ i Y<\/p>\n
assessed the monthlyg  ‘deceased at
\neaooo\/~ and rightly’ ll  towards the
\npersonal and   deceased. but
\nslipped     the multiplier. It
\nhas   “age of the deceased for
\nadopting per the decision of the Apex<\/p>\n
Court-in  of ju-dglrnents including the decision in<\/p>\n
.ll”Sal1.’la Veniiejs case’ (2009 ACJ 1298), the age of the<\/p>\n
 of the deceased is to be taken into<\/p>\n
coIi’sidei”at_io’n for adopting multiplier. in the instant<\/p>\n
 the age of the younger parent, mother, was 50<\/p>\n
ll   at the time of death of deceased. Therefore, we<\/p>\n
“adopt: multiplier of ‘l3’ as against multiplier of ‘I?’<\/p>\n
adopted by ‘1″‘ribuna.1. Accordingly, We reedetermine<\/p>\n
compensation payable towards loss of dependeney:-Vpat_4<\/p>\n
?4,e8.o0o\/- (i.e. 2=3.0oo\/- x 12 x 13) as against a   <\/p>\n
$6, 12,000\/~ awarded by Tribunal.”<\/p>\n
7. However, having TV regard  thleV_-‘facts it <\/p>\n
circumstances of the case   the

\nhas rightly awarded $15,000\/-towards
\nloss of   loss of love and
\naffection     ?25,000\/- towards
\ntranspolrtation ‘  and funeral expenses.
