  as it relates to its liability to pay<\/p>\n
compen’sa,tion to respondent No.1 — claimant awarded<\/p>\n
 by__ the” “Claims Tribunal towards the death of her son,<\/p>\n
“.Wh’o died as a result of injuries sustained in the said<\/p>\n
it ” ” accident.\n<\/p>\n

2. I have heard the argument of the learned
\nAdvocates for both the sides. Perused the impugned<\/p>\n
Judgment and Award and the entire materiVa.1_’4’fo’t1ndV'”in<\/p>\n
the original records obtained from the  K V’ <\/p>\n

appellant — Insura.nce Co; _stronglvV-contendss’ that’.”the’ap<\/p>\n
deceased boy was traVellin’g~\u00bb.:._Vi11   tragctlor and
\ntrailer, which is a therefore the
\nappellant ~\u00ab  riolt to pay any
\namount of  No.1 — claimant,
\nthe   and hence the impugned
\nJudgmelnt\u00e9hpandll to be modified to this<\/p>\n
 He tu1*th__eijeontends that even if it is held that<\/p>\n
‘ the. .__boy was travelling in the said tractor and<\/p>\n
‘trailer Aalojngwith some quantities of rice, ragi etc., it<\/p>\n
cannot be held that the said rice, ragi etc. fall within the<\/p>\n
A ‘dd’ definition of goods as defined under Section 2[13) of M V<\/p>\n
l\u00a7.Act, 1988 so as to attract the provisions of Section<\/p>\n
(.\u00bbm_\u00ab:***-~w~…V–\u00ab<\/p>\n
l47′(l)(b)(i} of the said Act to fasten liability on the
\nInsurance Co. to pay the amount of compensation<\/p>\n
awarded to the claimant.\n<\/p>\n
4. Per contra, learned counsel for they-1$?’:’:’respondent–\u00ab.. <\/p>\n
, claimant strongly contends that  fdecehasedl <\/p>\n
travelling in the said trac’to’r._andt-trailer <\/p>\n
goods viz: rice, ragi and ot_h:er:_provisions:,. which were
\nnecessary for his farnilly.Aandittheieforey it could not be
\nsaid that the;-r v’decea’sedfA  unauthorised
\npassenger..ir1. _said’:t_ractor and trailer and hence, the
\nClairng  ‘ justified in fastening the<\/p>\n
liability the  — insurance C0. to pay the<\/p>\n
 V. y_ compensation ‘aw,a_1fded in favour of the claimant.<\/p>\n
V   _  that the motor Vehicle accident occurred<\/p>\n
at 9.00 p.m. involving the said tractor and<\/p>\n
 trailer” and that the deceased boy, who was travelling in<\/p>\n
  vehicle, fell down and sustained fatal injuries<\/p>\n
 and consequently died are not in dispute. PW1<\/p>\n

in her evidence that on the said date and <\/p>\n
deceased was returning to his viliage from-,,’KanaKapura <\/p>\n
after buying rice, ragi and oit’her.,proVisions for]. the<\/p>\n
family and therefore he was traxf\/e1_1i:i-3_gA’  said <\/p>\n
and trailer alongwith   the\u00bb<\/p>\n
evidence of PW1 do,e”s~.__not ‘.weyennfdis’e.1_ose” the quantity of
\nrice, ragi and other    carried by
\nthe  Besides this,
\nthere is    show that any quantity
\nof   foodgrains found in the said
\nvehicle;   to the accident, though<\/p>\n
has stated” evidence that he saw the accident that<\/p>\n
 .ocicu1’E19(::tiVV”oIi thevsafid date, time and place as a result of<\/p>\n
1   deceased boy, viz: Appaji, who was travelling<\/p>\n
in’\u00ab\u00ab..the_”t1’actor and trailer, fell down and sustained fatal<\/p>\n
 ..injuries and consequently died in the hospital as a<\/p>\n

6. This Court has held in the case of _<\/p>\n
Insurance Co. Ltd. -vs- Smt.Ii(M1lithabai’v– V. <\/p>\n
2007(3) Kar.LJ 501 that one tWyoe1\u00e9.:ages_1of<\/p>\n
and other house hold articles cannot  to <\/p>\n
‘goods’ as defined under   of..Sect_ionlf?2 of M V
\nAct and therefore the-firevaeien efelseyetsen 147[1)[b)(i) of
\nthe said Act CgC_1:l’l1T_.1()'[ be  liability on the
\nlnsurancefio.   to the claimant
\ntowards ‘-the ‘deceased, even if it is held that the<\/p>\n
deceasedtahloy tr.avel1ing in the said tractor and<\/p>\n
  tija’i1er__fat _the rele_vant time of accident alongwith some<\/p>\n
‘   rice, ragi and etc. said to have been<\/p>\n
 him at Kanakapura for his family.<\/p>\n
7’. ~ _”l’herefore, I am of the considered opinion that the<\/p>\n
  Tribunal cornrnitted error in holding that the<\/p>\n
 “appellant — Insurance Co. is liable to pay to claimant<\/p>\n
“\\’~(“\u00b0-.\n<\/p>\n

therein (131 respondent herein}, the amount of
\ncompensation awarded in her favour towards theutieath<\/p>\n

For the reasons aforesaid. the present, appeal <\/p>\n
